ORDINANCE NO. 2018- C(1 <br /> AN ORDINANCE OF THE CITY COMMISSION OF THE <br /> CITY OF SUNNY ISLES BEACH, FLORIDA, AMENDING <br /> SECTION 172-5 (B) OF THE CITY CODE ENTITLED <br /> "CHARITABLE DONATIONS" TO AUTHORIZE THE CITY <br /> MANAGER TO MAKE CHARITABLE CONTRIBUTIONS <br /> REGARDING IN-KIND GOODS AND SERVICES AND USE OF <br /> GOVERNMENT FACILITIES UP TO $10,000.00 TO NON- <br /> PROFIT ORGANIZATIONS; PROVIDING FOR REPEALER; <br /> PROVIDING FOR SEVERABILITY; PROVIDING FOR <br /> INCLUSION IN THE CITY CODE; PROVIDING FOR AN <br /> EFFECTIVE DATE. <br /> WHEREAS, the City Commission has made a commitment to support charitable <br /> organizations which provide services to the residents of the City of Sunny Isles Beach; and <br /> WHEREAS, Section C-7.6 of the City Charter, as well as Section 172-5 of the City Code, <br /> require the affirmative votes of at least four (4) members of the City Commission at a public <br /> meeting to approve charitable contributions for in-kind use of government facilities owned by the <br /> City; and <br /> WHEREAS, the City Commission wishes to amend Section 172-5 (B) of the City Code to <br /> authorize the City Manager to make charitable contributions regarding in-kind use of government <br /> facilities up to $10,000.00 in total cost of rent value to non-profit organizations. <br /> NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISISON OF THE <br /> CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> Section 1. Incorporation of Recitals. The foregoing "WHEREAS" clauses are hereby ratified and <br /> confirmed as being true and correct and are hereby made a specific part of this Ordinance upon <br /> adoption hereof <br /> Section 2. Amendment. Section 172-5 (B) of the Code of Ordinances of the City of Sunny Isles <br /> Beach is hereby amended to read as follows: <br /> § 172-5 Charitable Donations <br /> A. Financial Donations <br /> B. In-Kind Goods and Services and Use of Facilities. In-kind goods and services <br /> and use of the City's governmental facilities by charitable organizations must be <br /> approved by the affirmative votes of at least four members of the City Commission <br /> at a public meeting if such in-kind goods and services exceed a total cost of <br /> $10.000.00 for rent value or cost of goods. In-kind goods and services for charitable <br /> contributions under $10.000.00 in total cost maybe approved administratively by the <br /> City Manager. <br /> Words added underlined;words etricl.en deleted Page I of 2 <br />
