<br /> A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
<br /> SUNNY ISLES BEACH, FLORIDA, ("CITY") APPROVING A SITE
<br /> PLAN APPLICATION (Z2012-17) SUBMITTED BY TERRA
<br /> BEACHWALK, LLC ( THE "APPLICANT") FOR THE PROJECT
<br /> ENTITLED "ATLANTIC 15" FOR 15 SINGLE FAMILY HOMES
<br /> OF APPROXIMATELY 3,421 SQUARE FEET EACH; APPROVING
<br /> THE APPLICANT'S REQUEST FOR THE USE OF GRAPHICS
<br /> AND MURALS ON TEMPORARY CONSTRUCTION FENCING;
<br /> PROVIDING THE CITY MANAGER WITH THE AUTHORITY TO
<br /> DO ALL THINGS NECESSARY TO EFFECTUATE THIS
<br /> RESOLUTION; PROVIDING FOR SEVERABILITY; PROVIDING
<br /> FOR REPEALER; PROVIDING FOR AN EFFECTIVE DATE.
<br /> I. RECITALS
<br /> WHEREAS, Terra Beachwalk, LLC (the "Applicant") submitted a site plan application
<br /> (Z2012-17)to the City of Sunny Isles Beach, Florida requesting the following:
<br /> 1. Pursuant to Section 265-18 of the City of Sunny Isles Beach Land Development
<br /> Regulations, the Applicant is requesting a site plan approval for the project entitled
<br /> "Atlantic 15" for 15 single family homes of approximately 3,421 square feet each.
<br /> 2. Pursuant to Section 265-63.3 (G) of the City of Sunny Isles Beach Land Development
<br /> Regulations, the Applicant is requesting the use of graphics and murals on temporary
<br /> construction fencing.
<br /> LEGAL: Lots 2 and 3, Block 3, OCEAN BOULEVARD ESTATES SECTION "A",
<br /> according to the Plat thereof, as recorded in Plat Book 48, Page 39, of the Public
<br /> Records of Miami-Dade County, Florida.
<br /> TOGETHER WITH that portion of the West 1/2 of the vacated alleyway lying
<br /> East of and adjacent to Lots 2 and 3, Block 3, OCEAN BOUELVARD ESTATES
<br /> SECTION "A", as recorded in Plat Book 48, Page 39, per City of Sunny Isles
<br /> Resolution No. 2003-511, recorded April 18, 2003, in Official Records Book
<br /> 21181, Page 3232, of the Public Records of Miami-Dade County, Florida.
<br /> Lots 4, 5, 6, 7, 8 and 9, Block 3, GOLDEN SHORES OCEAN BOULEVARD
<br /> ESTATES SECTION "B", according to the Plat thereof, as recorded in Plat Book
<br /> 51, Page 15, of the Public Records of Miami-Dade County, Florida.
<br /> TOGETHER WITH that portion of the West '/2 of the vacated alleyway lying East
<br /> of and adjacent to Lots 4, 5, 6, 7, 8, and 9, Block 3, GOLDEN SHORES OCEAN
<br /> BOULEVARD ESTATES SECTION "B", as recorded in Plat Book 51, Page 15,
<br /> per City of Sunny Isles Resolution No. 2003-511, recorded April 18, 2003, in
