ORDINANCE NO. 2018- S 7-7-- <br /> AN <br /> 2AN ORDINANCE OF THE CITY COMMISSION OF THE <br /> CITY OF SUNNY ISLES BEACH, FLORIDA, AMENDING <br /> CHAPTER 217 ENTITLED "RENTAL PROPERTY," OF THE <br /> CODE OF ORDINANCES OF SUNNY ISLES BEACH TO <br /> CREATE A NEW ARTICLE ENTITLED "REGULATING <br /> SHORT TERM VACATION RENTALS IN MULTI-FAMILY <br /> DWELLINGS"; PROVIDING FOR DEFINITIONS; <br /> REQUIRING SHORT TERM VACATION RENTAL <br /> LICENSE; PROVIDING FOR GENERAL STANDARDS AND <br /> SAFETY REQUIREMENTS; PROVIDING FOR DUTIES OF <br /> RESPONSIBLE PARTY AND PEER—TO-PEER OR <br /> PLATFORM ENTITIES; PROVIDING FOR THE POSTING <br /> OF SHORT TERM RENTAL INFORMATION; PROVIDING <br /> FOR PENALTIES AND ENFORCEMENT; PROVIDING FOR <br /> SEVERABILITY; PROVIDING FOR REPEALER; <br /> PROVIDING FOR INCLUSION IN THE CODE; PROVIDING <br /> FOR AN EFFECTIVE DATE. <br /> WHEREAS, the City is granted the authority under its home rule power, to exercise any <br /> power for municipal purposes except when expressly prohibited by state law; and <br /> WHEREAS, the maintenance of the character of multi-family dwellings is within the <br /> home rule power of the City; and <br /> WHEREAS, the regulation of short-term vacation rentals in multi-family buildings <br /> serves a substantial governmental interest in preserving the character and integrity of residential <br /> neighborhoods; and <br /> WHEREAS, numerous local governments in the State of Florida and across the nation <br /> have standards in place to minimize the negative impacts caused by short-term vacation rentals; <br /> and <br /> WHEREAS, the presence of short-term vacation rentals within multi-family dwelling <br /> units can create negative compatibility, which includes but is not limited to, excessive noise and <br /> diminished public safety in high density buildings; and <br /> WHEREAS, short-term vacation rental occupants in multi-family buildings, due to the <br /> transient nature of their occupancy, are unfamiliar with local and residential evacuation plans, <br /> location of fire extinguishers, and other similar safety measures that would readily be provided to <br /> guests in traditional lodging establishments; and <br /> WHEREAS, the City Commission hereby finds this Ordinance necessary to protect the <br /> public welfare and to ensure to the residents the tranquility and peaceful enjoyment of their <br /> residences. <br /> New Article-Short-Term Vacation Rental Ordinance 1 Page I of 11 <br /> Words added underlined,words stricken deleted <br />
