ORDINANCE NO. 2018 - 52C. <br /> AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF <br /> SUNNY ISLES BEACH, FLORIDA, AMENDING CHAPTER 265 <br /> "ZONING" SECTION 265-46A.(17) TO CREATE INCENTIVES FOR <br /> PROVISION OF ELECTRIC CAR CHARGING STATIONS; PROVIDING <br /> FOR SEVERABILITY; PROVIDING FOR INCLUSION IN THE CODE; <br /> PROVIDING FOR REPEAL OF CONFLICTING PROVISIONS; AND <br /> PROVIDING FOR AN EFFECTIVE DATE. <br /> WHEREAS, the purpose of this Ordinance is to promote the public health, safety and <br /> welfare of the residents of the City of Sunny Isles Beach in the use and development standards for _ <br /> multi-family and hotel uses within the City which from time to time need to be clarified and <br /> adjusted; and <br /> WHEREAS,the City desires to provide incentives for the provision by private developers <br /> of electric car charging stations, in order to encourage the use of electric cars within the City to <br /> reduce auto emissions and enhance the public health, safety and welfare; and <br /> WHEREAS, the City has determined that a reasonable and appropriate incentive is to <br /> reduce the required off-street parking spaces where electric car charging stations are provided; and <br /> WHEREAS,the City Commission, acting as the City Local Planning Agency, pursuant to <br /> Section 57-2 of the City Code, reviewed and made recommendations regarding the proposed <br /> amendment to the City land development regulations. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY <br /> OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> Section 1. Incorporation of Recitals. The foregoing "WHEREAS" clauses are hereby ratified <br /> and confirmed as being true and correct and are hereby made a specific part by this Ordinance <br /> upon adoption hereof. <br /> Section 2. Amendment. Chapter 265,"Zoning", Section 265-46 is amended to add paragraph <br /> A. (17) to read as follows: <br /> § 265-46. - Off-street parking and loading standards. <br /> A. General. Every building, use or structure, constructed or altered after the effective date of <br /> LDRs shall be provided with off-street parking facilities in accordance with the provisions of <br /> this article for the use of occupants, employees, visitors or patrons. Such off-street parking <br /> facilities shall be maintained and continued as long as the main use is continued. <br /> 1 <br />
