Feedback: Client will use commercially reasonable efforts to review and <br />approve or reject each Deliverable within 2 business days for deliverables <br />listed in this document. If Client determines that a Deliverable is incomplete <br />or fails to satisfy the criteria for acceptance set forth in this document, <br />Client may choose not to accept such Deliverable and shall provide <br />Crea7ive with written notice detailing the manner in which the Deliverable <br />was incomplete or failed to comply with such criteria. Upon receipt of such <br />notice, Crea7ive shall, as its sole expense, adjust the unaccepted. <br />Deliverable and timeline and Client shall have the same period of time <br />within which to accept the corrected Deliverable. <br />The Parties agree to repeat this procedure twice. If after such attempts, the <br />non-conformities and deciencies are not corrected, The Client may, at its <br />option(i) upon mutual agreement, allow Crea7ive additional time to remedy <br />the deciencies; or (ii) terminate the Project Assignment. If a Deliverable is <br />not timely rejected, it shall be deemed accepted for payment purposes. In no <br />event shall Client's rationale for rejecting the Deliverable contradict Client's <br />prior acceptance of certain design features (e.g., color, layout, or functions), <br />which had been presented by Crea7ive in an earlier iteration of the same <br />Deliverable. <br />In the event that Client requests a fundamental change in scope at any point <br />in the project, a change order will be required. A change order will involve <br />assessing the amount of new design and/or development work will be <br />required as well as the amount of completed work that will need to be re- <br />designed or developed to calculate additional costs and adjust the project's <br />timeline. Crea7ive will notify Client as soon as possible if a change in scope <br />is detected to keep change order costs to a minimum. If change order costs <br />are not agreeable to Client, change of scope will not be accepted into the <br />project requirements.
