<br />City of Sunny Isles Beach |Request for Proposal No. 19-12-01 11 <br /> <br />adjustment should be submitted 90 days prior to expiration of the then current contract term. <br />The vendor adjustment request should not be in excess of the relevant pricing index change. If <br />no adjustment request is received from the vendor, the City will assume that the vendor has <br />agreed that the optional term may be exercised without pricing adjustment. Any adjustment <br />request received after the commencement of a new option period may not be considered. <br /> <br />The City reserves the right to negotiate lower pricing for the additional term(s) based on market <br />research information or other factors that influence price. The City reserves the right to apply any <br />reduction in pricing for the additional term(s) based on the downward movement of the <br />applicable index. <br /> <br />The City reserves the right to reject any price adjustments submitted by the vendor and/or to not <br />exercise any otherwise available option period based on such price adjustments. Continuation of <br />the contract beyond the initial period, and any option subsequently exercised, is a City <br />prerogative, and not a right of the vendor. This prerogative will be exercised only when such <br />continuation is clearly in the best interest of the City. <br /> <br />Should the vendor decline the City’s right to exercise the option period, the City may consider the <br />vendor in default which decision may affect that vendor’s eligibility for future contracts. <br /> <br />2.5 PRICE <br /> <br />If the vendor is awarded a contract under this solicitation, the prices proposed by the vendor <br />shall remain fixed and firm during the term of contract, except as detailed in Section 2.4 Options <br />to Renew. The price proposed shall be an all-inclusive price; no additional charges will be paid. <br />However, increases in the cost for postage may be requested on a yearly basis with sufficient <br />documentation and, increases for the cost of paper can be requested after the initial two-year <br />term, with 30 days prior written notice to the City. <br /> <br />2.5.1 POSTAGE <br /> <br />The price for postage will adhere to the current rates as set by the United States Postal <br />Service. Mailings are sent via bulk mail to zip code 33160, which include carrier routes 1, <br />9 and 47. Mailing lists should be updated monthly and should be sorted for duplicates. <br />Mailings are not to be addressed to each individual and should be addressed as <br />“Resident” instead. <br /> <br />2.6 PERFORMANCE AND PAYMENT BOND <br /> <br />Intentionally Omitted <br /> <br />2.7 INSURANCE <br /> <br /> Comprehensive General Liability with minimum limits of One Million Dollars ($1,000,000.00) per <br />occurrence combined single limit for Bodily Injury Liability and Property Damage Liability. <br />Coverage must be afforded on a form no more restrictive than the latest edition of the
