INDEPENDENT CONTRACTOR RELATIONSHIP. The Contractor is an <br /> independent contractor and shall be treated as such for all purposes. Nothing contained in this <br /> Agreement or any action of the parties shall be construed to constitute or to render the Contractor <br /> an employee, partner, agent, shareholder, officer or in any other capacity other than as an. <br /> independent contractor other than iluise obligations which have been or shall have been <br /> undertaken by the City. Contractor shall be responsible for any and all of its own expenses in <br /> performing its duties as contemplated ander this Agreement The City shall not he responsible for <br /> any expense incurred by the Contractor. The City shall have no duty to withhold any Federal <br /> income taxes or pay Social Security services and that such obligations shall be that of the <br /> Contractor, other than those sett forth in this Agreement. Contractor shall furnish its own <br /> transportation, office and other supplies as it determines ncccssaiiy in carrying out its duties under <br /> this Agreement. <br /> 9. OWNERSHIP OF DOCUMENTS AND EQUIPMENT. All documents prepared by <br /> the Contractor pursuant to this Agreement and related Services to this Agreement.are intended and. <br /> • <br /> represented for the ownership of the City only. Any other use by Contractor or other parties shall •• <br /> be approved is writing by the City. if requested, Contractor shall deliver the documents to the <br /> City within filleen(15)calendar days. <br /> 10. SAFETY MEASURES. Contractor shall take all necessary precautions for the safety of <br /> employees and shall erect and properly maintain at all times all. necessary safeguards for the <br /> protection of the employees and the public. Contractor to follow all OSHA Safety Standards. <br /> Danger signs warning against hazards created by his/her operation and work in progress must he <br /> posted. All employees of the contractor shall be expected to wear safety glasses or goggles, <br /> appropriate clothing, and hearing protection wbC:ti and wherever applicable, The contractor shall i <br /> use only equipment that is fully operational and hi safe operating order. Contractor shall be <br /> especially careful when servicing property when pedestrians and/ or vehicles are in close <br /> proximity--work shall cease until it is safe to proceed_ <br /> 1.1. ACCIDENT PREVENTION AND BARRICADES. Barricades, cones, construction <br /> fencing, temporary construction fencing and off duty police officers, per City regulations and <br /> other relevant requirements, shall be provided by the Contractor when work is perlurazed in areas <br /> traversed by persons, vehicular traffic•or when deemed necessary by the City Manager at no extra <br /> cost to the City. Precautions shall be exercised at all times for the protection Of persons and property.
