The following lists all claims, arbitrations, administrative hearings and lawsuits brought by
or against the Proposer or its predecessor organization(s) during the last ten (10) years.

Litigation History:Litigation History:Litigation History:Litigation History:

M.K. Contractors vs. Main Highway M.K. Contractors vs. Main Highway M.K. Contractors vs. Main Highway M.K. Contractors vs. Main Highway Development, LLCDevelopment, LLCDevelopment, LLCDevelopment, LLC
Coastal Systems International was named as a co-defendant in the litigation, M.K.
Contractors vs. Main Highway Development, LLC., Zyscovich, Inc., Louis J. Aguirre &
Associates, P.A., DDA Engineers, P.A., Kaderabek & Barreiro Consultants, Inc., and Coastal
Systems International. The case number is 10-01409 CA25 as filed in the Circuit Court of
Eleventh Judicial Circuit in Miami-Dade County. The General Contractor, M.K. Contractors,
for the Project filed a claim against the developer and the architectural/engineering
consultants on the project on January 12, 2010. The construction for the project was
completed in 2007. Coastal Systems filed a motion to dismiss the claim on January 29, 2010
for failure to state a cause of action on the professional negligence and violation of Florida
statute counts. M.K. Contractors is an incidental third-party beneficiary to the work
performed by Coastal Systems. The design work completed by Coastal Systems was limited
to the site/civil engineering and underground utilities, and therefore Coastal Systems was
not involved in any structure of the Condominium, therefore making the Building Code
claims inapplicable. This case was settled out of court in July 2014.

Canyon Ranch DevelopmentCanyon Ranch DevelopmentCanyon Ranch DevelopmentCanyon Ranch Development
The plaintiffs include the two condominium associations that filed 558 claims in August 2014
against the consulting team that included Coastal Systems. Coastal Systems only provided
Coastal Permitting services for these projects that are now part of the Canyon Ranch
development. No engineering design services were provided, and Coastal Systems has
disputed the 558 claims. Further litigation has not been filed to date.

American Automobile Ins Co vs GT McDonald Enterprises IncAmerican Automobile Ins Co vs GT McDonald Enterprises IncAmerican Automobile Ins Co vs GT McDonald Enterprises IncAmerican Automobile Ins Co vs GT McDonald Enterprises Inc
The plaintiff is the insurance company that provided coverage to the Gale Hotel for sewage
back-up as a result of the City of Miami Beach sewage pump station not functioning.
Sewage backed-up into the building, and the backflow preventers and other appurtenances
referenced in the claim are the responsibility of the building Mechanical/Electrical/Plumbing
(MEP) engineer and not Coastal Systems as the site/civil engineer. The claim was filed in
September 2014. Coastal Systems disputes the claim. The client served a notice for trial
and we will likely have to settle or attend mediation.

Capri South Beach Capri South Beach Capri South Beach Capri South Beach
A 558 claim has been filed August 2014, and Coastal Systems has coordinated with the
General Contractor to address maintenance issues with the site/civil improvements
referenced in the 558 claim. Coastal Systems is of the opinion that the alleged defects have
been adequately address. To date, no litigation has been filed. The file has been closed by
the insurance company.

Page 112
