CITY OF FORT LAUDERDALE <br />CONSTRUCTION AGREEMENT <br />THIS AGREEMENT made and entered into this 7th day of April <br />2020, by and between the City of Fort Lauderdale, a Florida municipal corporation <br />("City") and Team Contracting, Inc., a Florida corporation ("Contractor"), ("Parties"); <br />WHEREAS, the City desires to enter into a contract for Annual Concrete and <br />Paver Stones ("Project"), as expressed in its Invitation to Bid No. 12352-403, Project <br />Number 12517, which was opened on December 24, 2019; and <br />WHEREAS, the Contractor has expressed its willingness and capability to <br />perform the necessary work to accomplish the Project; <br />NOW, THEREFORE, the City and the Contractor, in consideration of the mutual <br />covenants and conditions contained herein and for other good and valuable <br />consideration, the receipt and sufficiency is hereby acknowledged, agree as follows: <br />ARTICLE 1 — DEFINITIONS <br />Whenever used in this Agreement or in other Contract Documents, the following terms <br />have the meanings indicated which are applicable to both the singular and plural forms: <br />1.1 Agreement — This written Agreement between the City and the Contractor <br />covering the work to be performed including other Contract Documents that are <br />attached to or incorporated in the Agreement. <br />1.2 Application for Payment — The form accepted by the City which is to be used by <br />the Contractor in requesting progress or final payment and which is to include <br />such supporting documentation as is required by the Contract Documents <br />1.3 Approve — The word approve is defined to mean review of the material, <br />equipment or methods for general compliance with design concepts and with the <br />design concepts and with the information given in the Contract Documents. It <br />does not imply a responsibility on the part of the City to verify in every detail <br />conformance with plans and specifications. <br />1.4 Bid — The offer or Bid of the Contractor submitted on the prescribed form setting <br />forth the total prices for the Work to be performed. <br />1.5 Bid Documents — This Agreement, advertisement for Invitation to Bid, the <br />Instructions to Bidders, the Bid Form (with supplemental affidavits and <br />agreements), the Contract Forms, General Conditions, the Supplementary <br />Conditions, the Specifications, and the Plans, which documents all become an <br />integral part of the Contract Documents. <br />CAM 20-0192 <br />C-1 EXHIBIT 3 <br />Page 1 of 46 <br />
