society, organization or associations, or to the code of any governmental authority <br />whether such reference be specific or implied, shall mean the latest standard <br />specification, manual or code in effect as of the Effective Date of this Agreement, except <br />as may be otherwise specifically stated. However, no provision of any referenced <br />standard specification, manual or code (whether or not specifically incorporated by <br />reference in the Contract Documents) shall change the duties and responsibilities of the <br />City, the Contractor, or any of their agents or employees from those set forth in the <br />Contract Documents. <br />ARTICLE 5 — CONTRACT TIME <br />5.1 The initial contract term shall commence upon the date specified in the Notice To <br />Proceed given by the City and shall expire two (2) years from that date. The City <br />reserves the right to extend the contract for two (2) additional one (1) year terms, <br />providing all terms, conditions and specifications remain the same, both parties <br />agree to the extension, and such extension is approved by the City. <br />5.2 The Contractor recognizes that TIME IS OF THE ESSENCE. The Work on each <br />Task Order shall commence immediately upon the Contractor's receipt of an <br />executed Task <br />Order. <br />5.3 The Contractor shall mobilize to the project site and begin construction activities <br />within seven (7) calendar days of receipt of the executed Task Order or by the <br />specific date noted within the Task Order (whichever applies). <br />5.4 The Work on each Task Order shall be substantially completed within the <br />timeframe agreed upon and noted in each executed Task Order. <br />5.5 The Work on each Task Order shall be finally completed on or before the Final <br />Completion Date and ready for final payment in accordance with Final <br />Completion Date agreed upon and noted in each executed Task Order. <br />5.6 In the event services are scheduled to end because of the expiration of this <br />contract, the Contractor shall continue the service upon the request of the City as <br />authorized by the awarding authority. The extension period shall not extend for <br />more than ninety (90) days beyond the expiration date of the existing contract. <br />The Contractor shall be compensated for the service at the rate in effect when <br />this extension clause is invoked by the City. <br />5.7 The termination date for issuance of Task Orders shall be when the funds are <br />depleted or when the termination date of the contract is reached, whichever <br />comes first.
