incorporation in the Work, or any invention, design, process, product or device <br />which is the subject of patent rights or copyrights held by others. The Contractor <br />hereby expressly binds himself or itself to indemnify and save harmless the City <br />from all such claims and fees and from any and all suits and action of every <br />name and description that may be brought against City on account of any such <br />claims, fees, royalties, or costs for any such invention or patent, and from any <br />and all suits or actions that may be brought against said City for the infringement <br />of any and all patents or patent rights claimed by any person, firm corporation or <br />other entity. <br />8.11 Permits: The Contractor shall obtain and pay for all permits and licenses. There <br />shall be no allowance for Contractor markup, overhead or profit for permits and <br />licenses. The Contractor shall pay all government charges which are applicable <br />at the time of opening of proposals. It shall be the responsibility of the Contractor <br />to secure and pay for all necessary licenses and permits of a temporary nature <br />necessary for the prosecution of Work. <br />8.12 Law and Regulations: The Contractor shall give all notices and comply with all <br />laws, ordinances, rules and regulations applicable to the Work. If the Contractor <br />observes that the specifications or plans are at variance therewith, the Contractor <br />shall give the Project Manager prompt written notice thereof, and any necessary <br />changes shall be adjusted by any appropriate modifications. If the Contractor <br />performs any work knowing or having reason to know that it is contrary to such <br />laws, ordinances, rules and regulations, and without such notice to the Project <br />Manager, the Contractor shall bear all costs arising therefrom; however, it shall <br />not be the Contractor's primary responsibility to make certain that the <br />specifications and plans are in accordance with such laws, ordinances, rules and <br />regulations. <br />8.13 Taxes: The Contractor shall pay all sales, consumer, use and other similar taxes <br />required to be paid by it in accordance with the laws of the City of Fort <br />Lauderdale, County of Broward, and State of Florida. <br />8.14 Contractor Use of Premises: The Contractor shall confine construction <br />equipment, the storage of materials and equipment and the operations of <br />workmen to areas permitted by law, ordinances, permits and/or the requirements <br />of the Contract Documents, and shall not unreasonably encumber the premises <br />with construction equipment or other materials or equipment. The Contractor <br />shall not enter upon private property for any purpose without first securing the <br />permission of the property owner in writing and furnishing the Project Manager <br />with a copy of said permission. This requirement will be strictly enforced, <br />particularly with regard to such vacant properties as may be utilized for storage <br />or staging by the Contractor. <br />The Contractor shall conduct his work in such a manner as to avoid damage to <br />adjacent private or public property.
