8.17 Safety and Protection: <br />8.17.1 The Contractor shall be responsible for initiating, maintaining and <br />supervising all safety precautions and programs in connection with the <br />Work. The Contractor shall take all necessary precautions for the safety <br />of, and shall provide the necessary protection to prevent damage, injury or <br />loss to: <br />8.17.1.1 All employees working on the project and other persons who <br />may be affected thereby. <br />8.17.1.2 All the Work and all materials or equipment to be incorporated <br />therein, whether in storage on or off the site. <br />8.17.1.3 Other property at the site or adjacent thereto, including trees, <br />shrubs, lawns, walks, pavements, roadways, structures and <br />utilities not designated for removal, relocation or replacement in <br />the course of construction. <br />8.17.2 The Contractor shall comply with all applicable laws, ordinances, rules, <br />regulations and orders of any public body having jurisdiction for the safety <br />of persons or property or to protect them from damage, injury or loss; and <br />shall erect and maintain all necessary safeguards for such safety and <br />protection. The Contractor shall notify owners of adjacent property and <br />utilities when execution of the Work may affect them at least seventy-two <br />(72) hours in advance (unless otherwise required). All damage, injury or <br />loss to any property caused, directly or indirectly, in whole or in part by the <br />Contractor, any subcontractor or anyone directly or indirectly employed by <br />any of them or anyone for whose acts any of them may be liable, shall be <br />remedied by the Contractor. The Contractor's duties and responsibilities <br />for safety and protection of the Work shall continue until such time as all <br />the Work is completed and accepted by the City. <br />8.18 Emergencies: In emergencies affecting the safety or protection of persons or the <br />Work or property at the site or adjacent thereto, the Contractor, without special <br />instruction or authorization from the City, is obligated to act to prevent threatened <br />damage, injury or loss. The Contractor shall give the Project Manager prompt <br />written notice of any significant changes in the Work or deviations from the <br />Contract Documents caused thereby. <br />8.20 Risk of Loss: The risk of loss, injury or destruction shall be on the Contractor <br />until acceptance of the Work by the City. Title to the Work shall pass to the City <br />upon acceptance of the Work by the City. <br />8.21 Environmental: The Contractor has fully inspected the Premises and agrees, <br />except as to the presence of any asbestos, to accept the Premises in an "as is" <br />physical condition, without representation or warranty by the City of any kind, <br />including, without limitation, any and all existing environmental claims or <br />CAM 20-0192 <br />C-15 EXHIBIT 3 <br />Page 15 of 46 <br />
