Such a review will be conducted ninety (90) days prior to the contract <br />anniversary date and proposer will be provided a written copy of the review. Within thirty (30) days <br />of the sending of the review, Contractor shall respond to the review in writing, and the parties shall <br />meet to discuss the review and other pertinent subjects. A final report that will consist of the review, <br />proposer's written response, and a summary of the annual review meeting will be prepared by City <br />staff with a copy sent to the City Manager and proposer. <br />The proposer agrees that all records, equipment, personnel, office and storage facilities shall be <br />subject to periodic checks and quarterly audits by representatives of the City without prior notice. <br />3.12 STORAGE <br />The Contractor will maintain a storage garage and outside storage facilities complying with all <br />provisions of applicable building, zoning, environmental and ADA regulations sufficient to store all <br />vehicles under this contract until such vehicle(s) are claimed by the owner or otherwise disposed of <br />legally. The principal compound maintained by the Contractor, must be of sufficient size and capability <br />to accommodate impounded vehicles. Said compound shall be owned or leased by the Contractor and <br />shall be located in accordance with the distance requirements as specified by Florida Statute 715.07 <br />et al. Storage facilities shall have office and restroom facilities. No repair work or servicing of vehicles <br />shall be permitted in the storage area. The storage facility shall meet the specifications set forth in <br />Section 713.78 (7)(b) as amended from time to time. <br />3.13 RELEASE <br />In the event the owners do not apply for release of the vehicle within the statutory period (F. S. <br />713.78), the Police Department must be notified prior to any procedure to junk or otherwise dispose <br />of the vehicle. Any confiscated vehicle identified by the Police Department as one for which they are <br />undergoing legal proceedings for transfer of title, or which is being held as part of a criminal <br />investigation, shall be handled in compliance with instructions of the Police Department. The owner <br />shall be furnished with an itemized statement of all charges for the impounding of the vehicle when <br />an impounded vehicle is claimed by the owner. The Contractor shall receive from the vehicle owner a <br />receipt and release for the vehicle and all the personal property therein, and the Contractor shall retain <br />receipts for one year. <br />The City of Sunny Isles Beach shall not be held responsible or liable to the Contractor for nonpayment <br />of any towing or storage fees to the Contractor by the owner of the vehicle. Personal property in the <br />vehicle stored by the Contractor shall not be disposed of to defray any charges for towing or storage <br />of vehicles without a court order. <br />3.14 VIEWING OF IMPOUNDED VEHICLEVREMOVAL OF PERSONAL PROPERTY <br />The Contractor shall allow the registered owner of an impounded vehicle or the registered owner's <br />agent or insurance representative (upon presentation of proper identification) to view and photograph <br />said vehicle on the Contractor's premises between the hours of 8:00 a.m. and 8:00 p.m., 7 days a week, <br />without any restrictions or requirements, other than proof of ownership or agency. If such proof of <br />ownership is claimed to be in the vehicle, the Contractor shall retrieve those items. <br />The Contractor shall permit every vehicle owner or authorized representative to inspect the towed <br />vehicle immediately upon his/her arrival at the storage site and before a ment of char es.
