On February 20, 2020, the City timely <br />filed a notice of appeal based on denial <br />of its defense of sovereign immunity <br />and the action was stayed pursuant to <br />the City’s notice of automatic stay. On <br />May 12, 2020, Plaintiff moved to <br />dismiss the appeal as moot based on the <br />filing of its Amended Complaint. On <br />June 10, 2020, the Third District Court <br />of Appeal dismissed the appeal as moot <br />noting that: “the initial complaint which <br />Appellant asks this Court to conclude <br />should have been dismissed is no longer <br />operative.” At this time the City has <br />until June 25, 2020 to file a motion for <br />rehearing of that dismissal. If no such <br />motion is filed, the case will be <br />remanded to the trial court and the City <br />will respond to the Amended Complaint. <br />SCHEDULE 12(f)-2 <br /> <br />
