<br />1.3Approve – The word approve is defined to mean reviewof the material, equipmentor
<br />methods for general compliance with design concepts and with the design concepts and
<br />with the information given in the Contract Documents. It does not imply a responsibility on
<br />the part of the CITY to verify in every detail conformance with plans and specifications.
<br />1.4 Bid – The offer or Bid of the CONTRACTOR submitted on the prescribed form setting forth
<br />the total prices for the Work to be performed.
<br />1.5 Bid Documents –This Agreement, the Instructions to Bidders, the Bid Form (with
<br />supplemental affidavits and agreements), the Contract Forms, General Conditions, the
<br />Supplementary Conditions, the Specifications, and the Plans, which documents all become
<br />an integral part of the Contract Documents.
<br />1.6 Certificate of Substantial Completion - Certificate provided by the CITY certifying that all
<br />Work, excludingthepunchlist items, hasbeen completed, inspected, and accepted by the
<br />CITY.
<br />1.7 Change Order - A change order is defined as a written order to a CONTRACTOR approved by
<br />the CITY, authorizing a revision of an underlying agreement between the CITY and a
<br />CONTRACTOR that is directly related to the original scope of work or an adjustment in the
<br />original contract price or the contract time directly related to the original scope of work,
<br />issued on or after the effective date of the contract.
<br />1.8 CITY – The City of Sunny Isles Beach, Florida including but not limited to its employees,
<br />agents, officials, representatives, contractors, subcontractors, volunteers, successors and
<br />assigns, with whom the CONTRACTOR has entered into the Agreement and for whom the
<br />Work is to be provided. The Project Manager, or designee, shall be the authorized agent for
<br />the CITY unless otherwise specified.
<br />1.9 Contract Documents – The Contract Documents shall consist of this Agreement, Exhibits
<br />to this Agreement, the Bid Documents, Public Construction Bond, Performance Bond,
<br />Payment Bond and Certificates of Insurance, Notice of Award and Notice to Proceed,
<br />General Conditions as amended by the Special Conditions, Technical Specifications,
<br />Plans/Drawings, Addenda, Bid Form and supplement Affidavits and Agreements, all
<br />applicable provisions of State and Federal Law and any modification, including Change
<br />Orders or written amendments duly delivered after execution of Agreement, Invitation to Bid,
<br />Instructions to Bidders and Bid Bond, CONTRACTOR’s response to the CITY’s Invitation to
<br />Bid, Schedule of Completion and Schedule of Values, all amendments, modifications and
<br />supplements, change orders and work directive changes issued on or after the Effective
<br />Date of the Agreement, as well as any additional documents that are required to be
<br />submitted under the Agreement.
<br />The Contract Documents shall also consist of the Federal Provisions Related to Grant Funds
<br />attached to the Bid Documents, the State of Florida Department of Environmental Projection
<br />(“FDEP”) Grant Agreement with the CITY (Agreement No. 22FRP50), the American Rescue Plan
<br />Act (“ARPA”) Grant Agreement with the CITY (Agreement No. Y5301), the State of Florida
<br />Department of Environmental Projection (“FDEP”) Grant Agreement with the CITY (Agreement
<br />No LPA0391).
<br />Permits on file with the CITY and or those permits to be obtained shall be considered
