ITB 23-03-01 Sunny Isles Beach Central Island Area Drainage Improvement and North Miami Beach Distribution System Watermain Replacements directive in nature and willbeconsidered a part of this Agreement. A copyof all permits shall be given to the CITY for inclusion in the Contract Documents. Terms of permits shall be met prior to acceptance of the Work and release of the final payment. 1.10 Contract Price – The monies payable to the CONTRACTOR by the CITY under the Contract Documents and in accordance withtheline-itemunit priceslisted in the Bid. 1.11 Contract Time – The number of calendar days stated in the Agreement for the completion of the Work. The dates on which the work shall be started and shall be completed as stated in the Notice to Proceed. 1.12 CONTRACTOR – The person, firm, company, or corporation with whom the CITY has entered intothe Agreement, including butnotlimited to its employees, agents, representatives, CONTRACTORs, subcontractors, their subcontractors and their other successors and assigns. 1.13 Day – A calendar day of twenty-four (24) hours ending at midnight. 1.14 Defective – An adjective which when modifying the word “Work” refers to work that is unsatisfactory, faulty, or deficient, or does not conform to the Contract Documents or does not meet the requirements of any inspection, test or approval referred to in the Contract Documents, or has been damaged prior to the Project Manager’s recommendation of final payment. 1.15 Effective Date of the Agreement – The date specified in the Notice to Proceed given by the CITY to the CONTRACTOR indicating when the Contract Time will commence to run and on which the Agreement becomes effective, but if no such date is indicated, it means the date on which the Agreement is approved by the CITY Commission or if CITY Commission approval is not required it is the date on which the Agreement is fully executed by the CITY. 1.16 Final Completion Date – The date the Work is completed, including completion of the final punch list, and delivered along with those items specified in the Contract Documents and is accepted by the CITY. 1.17Hazardous Materials (HAZMAT) - Anysolid,liquid,or gaseous material that is toxic, flammable, radioactive, corrosive, chemically reactive, or unstable upon prolonged storage in quantities that could pose a threat to life, property, or the environment defined in Section 101(14) of Comprehensive Environmental Response, Compensation and Liability Act of 1980 and in 40 CFR 300.6. Also defined by 49 CFR171.8 as a substance or material designated by the Secretary of Transportation to be capable of posing an unreasonable risk to health, safety, and property when transported in commerce and which has been so designated. 1.18 Hazardous Substance - As defined by Section 101(14) of the Comprehensive Environmental Response, Compensation and Liability Act; any substance designated pursuant to Section 311(b) (2) (A) of the Clean Water Act; any element, compound, mixture, solution or substance designated pursuant to Section 102 identified under or listed pursuant to Section 3001 of the Solid Waste Disposal Act {but not including any waste listed under Section 307\[a\] of the Clean Water Act}; any hazardous air pollutant listed under Section PAGE 3 OF 38
