ITB 23-03-01 Sunny Isles Beach Central Island Area Drainage Improvement and <br />North Miami Beach Distribution System Watermain Replacements <br />directive in nature and willbeconsidered a part of this Agreement. A copyof all permits <br />shall be given to the CITY for inclusion in the Contract Documents. Terms of permits shall <br />be met prior to acceptance of the Work and release of the final payment. <br /> <br />1.10 Contract Price – The monies payable to the CONTRACTOR by the CITY under the Contract <br />Documents and in accordance withtheline-itemunit priceslisted in the Bid. <br />1.11 Contract Time – The number of calendar days stated in the Agreement for the completion <br />of the Work. The dates on which the work shall be started and shall be completed as <br />stated in the Notice to Proceed. <br />1.12 CONTRACTOR – The person, firm, company, or corporation with whom the CITY has entered <br />intothe Agreement, including butnotlimited to its employees, agents, representatives, <br />CONTRACTORs, subcontractors, their subcontractors and their other successors and <br />assigns. <br />1.13 Day – A calendar day of twenty-four (24) hours ending at midnight. <br />1.14 Defective – An adjective which when modifying the word “Work” refers to work that is <br />unsatisfactory, faulty, or deficient, or does not conform to the Contract Documents or does <br />not meet the requirements of any inspection, test or approval referred to in the Contract <br />Documents, or has been damaged prior to the Project Manager’s recommendation of final <br />payment. <br />1.15 Effective Date of the Agreement – The date specified in the Notice to Proceed given by <br />the CITY to the CONTRACTOR indicating when the Contract Time will commence to run <br />and on which the Agreement becomes effective, but if no such date is indicated, it <br />means the date on which the Agreement is approved by the CITY Commission or if CITY <br />Commission approval is not required it is the date on which the Agreement is fully <br />executed by the CITY. <br />1.16 Final Completion Date – The date the Work is completed, including completion of the final <br />punch list, and delivered along with those items specified in the Contract Documents <br />and is accepted by the CITY. <br />1.17Hazardous Materials (HAZMAT) - Anysolid,liquid,or gaseous material that is toxic, <br />flammable, radioactive, corrosive, chemically reactive, or unstable upon prolonged <br />storage in quantities that could pose a threat to life, property, or the environment <br />defined in Section 101(14) of Comprehensive Environmental Response, Compensation and <br />Liability Act of 1980 and in 40 CFR 300.6. Also defined by 49 CFR171.8 as a substance or <br />material designated by the Secretary of Transportation to be capable of posing an <br />unreasonable risk to health, safety, and property when transported in commerce and <br />which has been so designated. <br />1.18 Hazardous Substance - As defined by Section 101(14) of the Comprehensive Environmental <br />Response, Compensation and Liability Act; any substance designated pursuant to Section <br />311(b) (2) (A) of the Clean Water Act; any element, compound, mixture, solution or <br />substance designated pursuant to Section 102 identified under or listed pursuant to <br />Section 3001 of the Solid Waste Disposal Act {but not including any waste listed under <br />Section 307\[a\] of the Clean Water Act}; any hazardous air pollutant listed under Section <br />PAGE 3 OF 38 <br /> <br />
