ITB 23-03-01 Sunny Isles Beach Central Island Area Drainage Improvement and <br />North Miami Beach Distribution System Watermain Replacements <br />4.6 Plans/Drawings. <br /> <br />4.7 Bid Form and supplement Affidavits and Agreements. <br /> <br />4.8 All applicable provisions of State and Federal Law and any modification, including <br />Change Orders or written amendments duly delivered after execution of Agreement. <br /> <br />4.9 Instructions to Bidders and Bid Bond. <br /> <br />4.10 CONTRACTOR’s response. <br /> <br />4.11 Schedule of Completion and Schedule of Values. <br /> <br />4.12 All amendments, modifications and supplements, change orders and work directive <br />changes, issued on or after the Effective Date of the Agreement. <br />4.13 Any Additional documents that are required to be submitted under the Agreement. <br /> <br />4.14 Permits on file with the CITY and or those permits to be obtained shall be considered <br />directive in nature and will be considered a part of this Agreement. A copy of all <br />permits shall be given to the CITY for inclusion in the Contract Documents. Terms of <br />permits shall be met prior to acceptance of the Work and release of the final payment. <br /> <br />There are no Contract Documents other than those listed in this Article 4. The Contract <br />Documents may only be altered, amended, or repealed in accordance with the provisions of the <br />terms of this Agreement. <br />In the event of any conflict between the documents or any ambiguity or missing specification or <br />instruction, the following priority is established: <br /> <br />a. Specific direction from the CITY Manager (or designee). <br /> <br />b. This Agreementand any attachments. <br /> <br />c. ITB and the specifications prepared by the CITY. <br /> <br />d. CONTRACTOR’s response <br /> <br />e. Schedule of Values. <br /> <br />f. Schedule of Completion. <br /> <br />If during the performance of the Work, CONTRACTOR finds a conflict, error or discrepancy in the <br />Contract Documents, CONTRACTOR shall so report to the Project Manager, in writing, at once and <br />before proceeding with the Work affected shall obtain a written interpretation or clarification from <br />the CITY. <br />It is the intent of the specifications and plans to describe a complete Project to be constructed in <br />PAGE 6 OF 38 <br /> <br />
