ITB 23-03-01 Sunny Isles Beach Central Island Area Drainage Improvement and <br />North Miami Beach Distribution System Watermain Replacements <br /> Waiver of Subrogation <br /> <br />10.3.5 Workers’ Compensation and Employer’s LiabilityInsurance <br /> <br />Limits: Workers’ Compensation – Per Florida Statute 440 <br /> Employers’ Liability - $500,000 <br /> <br />Any firm performing work on behalf of the City of Sunny Isles Beach must provide <br />Workers’ Compensation insurance. Exceptions and exemptions can only be made if they <br />are in accordance with Florida Law. <br /> <br />The CONTRACTOR must be in compliance with all applicable State and Federal workers’ <br />compensation laws, including the U.S. Longshore Harbor Workers’ Act or Jones Act. <br /> <br />10.3.6 Umbrella/Excess Liability: The CONTRACTOR shall provide umbrella/excess <br />coverage with limits of no less than $2,000,000 excess of Commercial General <br />Liability, Automobile Liability and Employer’s Liability. <br /> <br />10.3.7 Environmental Pollution Insurance. The CONTRACTOR shall carry an Environmental <br />Pollution Insurance for pollution-related incidents, including the cost of cleaning up <br />a site after a pollution incident, with limits not less than $500,000.00 Dollars per <br />occurrence with deductible not greater than $100,000.00. An additional Form or <br />endorsement to the Commercial General Liability Insurance to include an <br />Environmental Pollution Insurance coverage providing the specified coverage, is <br />acceptable. <br />10.3.8 All insurance policies required above shall be issued by companies authorized to <br />do business under the laws of the State of Florida, with the following <br />qualifications: <br /> <br /> The CONTRACTOR’s insurance must be provided by an A.M. Best’s “A-“rated or <br />better insurance company authorized to issue insurance policies in the State of <br />Florida, subject to approval by the CITY’s Risk Manager. Any exclusions or provisions <br />in the insurance maintained by the CONTRACTOR that precludes coverage for work <br />contemplated in this project shall be deemed unacceptable and shall be considered <br />breach of contract. <br /> <br />NOTE: CITY BID NUMBER MUST APPEAR ON EACH CERTIFICATE. <br /> <br />mpliance with the foregoing requirements shall not relieve the CONTRACTOR of <br />Co <br />their liability and obligation under this section or under any other section of this <br />Agreement. <br /> <br />The CONTRACTOR shall be responsible for assuring that the insurance certificates <br />required in conjunction with this Section remain in force for the duration of the <br />Project.
