<br />15 <br /> <br />CITY OF SUNNY ISLES BEACH <br />18070 Collins Ave. | Sunny Isles Beach, FL 33160 <br />305.792.1707 | sibfl.net | Purchasing@sibfl.net <br /> <br />• The Contractor, in accepting an agreement, agrees that the City shall not be liable to <br />prosecution for damages in the event that the City declares the Contractor in default. <br /> <br />2.15 LIQUIDATED DAMAGES <br />Failure to complete all the work within the time specified above, including any extension granted in <br />writing by the City, shall obligate the Contractor to pay the City, as liquidated damages and not as a <br />penalty, an amount equal to One-Hundred Dollars ($100) for each calendar day of delay in the <br />completion of all the work. If any liquidated damages are unpaid by the Contractor, the City shall be <br />entitled to deduct these unpaid liquidated damages from the monies due the Contractor. Liquidated <br />damages are fixed and agreed upon between the Parties, recognizing the impossibility of precisely <br />ascertaining the amount of damages that will be sustained by the City as a consequence of such delay <br />and both parties desiring to obviate any question of dispute concerning the amount of damages and <br />the cost and effect of the failure of the Contractor to complete the Work on time. Liquidated damages <br />shall apply separately to each portion of the Work for which a time of completion is given. <br />2.16 UNSATISFACTORY SERVICES TO BE CORRECTED BY THE CONTRACTOR <br />In addition to random or unannounced inspections, the City will conduct planned inspections. <br />When either planned or unplanned inspection efforts identify Non-Compliant Work or <br />Unsatisfactory Work, the Contractor will be notified in writing, and the City will conduct a <br />subsequent inspection to ensure compliance. The City will incur additional administrative <br />expenses for the additional time required to re-inspect Contractor Work. Upon failure of <br />CONTRACTOR to complete the Work within the time specified for final completion, the City shall <br />impose deductions to invoice. <br />2.17 SALES TAX <br />Florida State Sales Tax is due on all transactions pursuant to Florida Statues and the Rules in Chapter <br />12 of the Florida Administrative Code, (FAC) promulgated by the Florida Department of Revenue. The <br />contractor shall be responsible for collecting and reporting all sales tax to the State of Florida <br />Department of Revenue. <br /> <br />The City is exempt from any taxes imposed by the State of Florida and/or Federal Government. State <br />Sales Tax Exemption Certificate No. 85-8015922477C-2; United States Treasure Department. <br />Exemption Certificates provided on request. <br /> <br />2.18 FEDERAL AND STATE REGULATIONS <br /> <br />The successful Proposer shall comply with all federal, state and local rules and regulations <br />regarding food handling, operation of a concession business, and any other laws that would apply <br />to operating a similar type of business. Special attention must be paid to the regulations outlined <br />by the State of Florida, Department of Professional and Business Regulation, Division of Hotels <br />and Restaurants.
