City and Contractor agree to <br />comply with and observe all applicable laws, codes and ordinances as that may in any way affect <br />the goods or equipment offered, including but not limited to: <br /> <br />a) Executive Order 11246, which prohibits discrimination against any employee, applicant, <br />or client because of race, creed, color, national origin, sex, or age with regard to, but not <br />limited to, the following: employment practices, rate of pay or other compensation <br />methods, and training selection. <br />b) Occupational, Safety and Health Act (OSHA), as applicable to this Formal Solicitation. <br />c) The State of Florida Statutes, Section 287.133(3)(A) on Public Entity Crimes. <br />d) Environment Protection Agency (EPA), as applicable to this Formal Solicitation. <br />e) Uniform Commercial Code (Florida Statutes, Chapter 672). <br />f) Americans with Disabilities Act of 1990, as amended. <br /> <br />2.19 LABOR, MATERIALS, AND EQUIPMENT SHALL BE SUPPLIED BY THE VENDOR <br />Unless otherwise provided in Section 3 of this solicitation the proposer shall furnish all labor, <br />material and equipment necessary for satisfactory contract performance. When not specifically <br />identified in the technical specifications, such materials and equipment shall be of a suitable type <br />and grade for the purpose. All material, workmanship, product, equipment, supplies and <br />personnel shall be subject to the inspection and approval of the City's Project Manager. <br /> <br />2.20 PERMITTING FEES <br /> <br />The Contractor shall be responsible for securing any and all licenses and/or permits for food and <br />non–alcoholic beverage concession stands. Any fee or payment charged for applicable licenses <br />and/or permits are at the sole expense of the Contractor. This shall relate to laws currently in <br />force and those adopted later. Contractor shall prepare, finalize, and process all applications for <br />renewal of licenses and/ or permits. Contractors will not have to pay for an additional permit to <br />run the operation at our facilities. <br /> <br />2.21 TAXES & ASSESTMENTS <br />The Gateway Center Property is presently deemed to be exempt from Property Taxes. It is the <br />intent of the Licensee and City that the Property be exempt from real estate taxes throughout the <br />Term of the contract. “Property Taxes” shall mean all ad valorem real estate taxes and special <br />assessments that may be levied against the Gateway Center Property by any taxing authority, so <br />long as such tax is based upon or measured by the valuation of the Gateway Center Property. In <br />the event it is determined by any competent authority that the Gateway Center Property is <br />subject to Property Taxes as a result of the use of portions of the Property by Licensee, then the <br />Licensee shall pay the Property Taxes apportioned for such use. <br /> <br />2.22 USE OF SUB-CONTRACTORS <br /> <br />If one or more subcontractors are to be used, the subcontractor must be clearly identified and <br />noted in the submittal when it is submitted.
