Shubin Law Group <br />PROFESSIONAL ASSOCIATION <br />December 6, 2024 <br />Amy Canales, Planning and Zoning Director <br />City of Sunny Isles Beach <br />18070 Collins Avenue, 311 Floor <br />Sunny Isles Beach, Florida 33160 <br />CITY OF <br />y \SLES� <br />L e �IBM/- <br />RECEIVED <br />1/9/2025 <br />PZ2024-07 <br />PLANNING & ZONING DEPT. <br />Re: Second Amended Letter of Intent/La Playa Beach Associates, LLC/18801 <br />Collins Avenue Application for Modification of Previously Approved Site - <br />Plan ("Application") <br />Dear Ms. Canales: <br />On behalf of this firm's client, La Playa Beach Associates LLC ("Applicant"), we <br />respectfully submit this Second Amended Letter of Intent in support of the Application for major' <br />modifications to the previously approved site plan seeking a density decrease and minor plan <br />amendments for the approximately 4.716 -acre oceanfront property located at 18801 Collins <br />Avenue (the "Property"). <br />In 2022, through Resolution 22-Z-189, the City approved a Major Site Plan Modification <br />for the Property that included a phased project with 490 residential units within two approximately <br />750 -foot -high towers consisting of 62 stories each, and the following amenities: (i) an 8,000 sqft. <br />private spa exclusive for Resident and Club Member use; (ii) an 8,462 sqft. public restaurant <br />consisting of 5,550 sqft. of indoor dining and 2,912 sqft. of outdoor dining; (iii) a Beach Bar & <br />Grill consisting of 3,450 sqft. of indoor dining and 1,750 sqft. of outdoor dining exclusive for <br />Resident and Club Member use; (iv) Conditional Use approval for a private members' Club; (iv) <br />17 private cabanas; and (v) 13 guest suites (the "2022 Approval").2 The total approved floor area <br />ratio, including approved transfer of development rights ("TDRs"), is 5.98 (1,228,435 sqft.). <br />1 While we maintain that the proposed amendments satisfy the requirements for a minor <br />modification under Section 265-18, City Code because they do not depart from the principal <br />concept of the approved plan, we understand that the City's position is that the substantial decrease <br />in proposed density requires review under the City's Major Site Plan Review process because the <br />proposed density results in more than a 5% decrease in project density.
