City of Sunny Isles Beach 18070 Collins Avenue, Sunny Isles Beach, Florida 33160 <br />(305) 947-0606 phone (305) 949-3113 Fax <br />2.4 The Contractor acknowledges and agrees that the term "flowable fill," included in <br />Contract Documents as a specific unit price, includes removal and disposal of unsuitable spoil <br />material and is subject to the City's approval before including flowable fill into the Work. <br />2.5 Direct Purchase. The City is recognized by the State of Florida as being exempt <br />from state sales tax and is therefore, qualified for an exemption from Florida and all other state <br />sales taxes on the purchase of tangible property if certain criteria are met. The City may elect to <br />realize savings of sales tax on selected material and equipment needed for use in this Project. The <br />City will include this direct purchase provision and the Contractor agrees to administer it. See Rule <br />12A-1.094 of the Florida Administrative Code, and Section 212.08(6), Florida Statutes. No <br />additional compensation shall be added to the Agreement amount because of the service provided <br />by the Contractor in the purchase of the material or capital equipment in the name of the City. All <br />sales and use tax savings of purchase of property, materials, etc., shall be credited to the City and <br />the amount of the Agreement will be reduced in the full amount of savings which are affected by <br />the omission of payment of sales and use taxes. <br />ARTICLE Ill <br />CONTRACT TIME <br />3.1 Time <br />3.1.1 The Contractor shall neither commence any work, nor enter a City work <br />premise, until a written Notice to Proceed (NTP) from the City directing the Contractor to <br />proceed with the work has been received by the Contractor from the City Manager or <br />designee; provided however, that such notification shall be superseded by any emergency <br />work that may be required in accordance with provisions included elsewhere in the <br />Contract Documents. In addition to the written NTP, the Contractor must supply the City <br />with the required insurance and bond documents. The Project shall be substantially <br />completed by June 24, 2026, which is four hundred and ninety-four (494) calendar <br />days from the Project initiation specified in the original and first Notice to Proceed and <br />final completion shall be thirty (30) calendar days after Substantial Completion. The total <br />five -hundred and twenty-four (524) calendar days include weekend days and holidays. <br />For the purposes of this Project, Final Completion shall be defined at that point after which <br />the City Engineer or their representative, have made and approved the Final Inspection and <br />the Punch List has been completed, and all deliverables have been provided to the City. <br />3.2 Notice to Proceed <br />3.2.1 Once a Notice to Proceed has been issued, the Contractor shall be responsible <br />for the timely and successful completion of the Work and shall endeavor to provide <br />all applicable agencies having jurisdiction with all the required documentation needed to <br />successfully and timely continue the progress of the Work. This may include, but is <br />not limited to providing all necessary documentation in the form of shop drawings, <br />clarifications, calculations, technical data, protocols, product approvals, etc. <br />3.2.2 Under no circumstances will the City accept claims or be responsible for <br />delays arising from failed, unsuccessful, untimely, or late inspections, or rejections of <br />inspected Work due to the fault of the Contractor for not supplying all of the necessary <br />COMTECH ENGINEERING, INC. <br />
