Contractor may not rely upon any testing performed by the City or the City's <br />Representative but shall remain solely responsible for insuring compliance with all <br />Contract Documents and testing requirements. The Contractor shall be responsible for <br />the payment of any of its testing. <br />ARTICLE VIII <br />CONTRACT ADMINISTRATION <br />8.1 City's Consultant Engineer <br />8.1.1 The City's Consultant Engineer for this project is Calvin Giordano & <br />Associates. In the event the City should find it necessary or convenient to replace the <br />Consultant Engineer the City shall retain a replacement Consultant Engineer and the status <br />of the replacement Engineer shall be that of the former Engineer. <br />8.2 Ci . 's Representative <br />8.2.1 The City's Representative, unless otherwise directed by the City in writing, <br />will perform those duties and discharge those responsibilities allocated to the Engineer as <br />set forth in the Contract Documents and this Contract. The City's Representative shall be <br />the City's representative from the effective date of this Contract until final payment has <br />been made. The City's Representative shall be authorized to act on behalf of the City only <br />to the extent provided in this Contract. <br />8.2.2 The Contractor and the City's Consultant Engineer shall communicate with <br />each other in the first instance through the City's Representative. The City's designated <br />representative for the receipt of any such communications, or copies of same, is Fabricio <br />Volpi, City of Sunny Isles Beach, 18070 Collins Ave, Sunny Isles Beach, FL 33160, and <br />email fvolpi@sibfl.net. The City reserves the right to change its designated representative <br />upon written notice to the Contractor and City's Representative. <br />8.2.3 The City's Consultant Engineer shall be the initial interpreter of the <br />requirements of the drawings and specifications and the judge of the performance there <br />under by the Contractor. The Engineer, through the City's Representative, shall render <br />written or graphic interpretations necessary for the proper execution or progress of the <br />Work with reasonable promptness on request of the Contractor. <br />8.2.4 The City's Representative will review the Contractor's Payment Requests and <br />will certify to the City for payment to the Contractor, those amounts then due the Contractor <br />as provided in this Contract. <br />8.2.5 The City's Representative shall have authority to reject Work which is <br />defective or does not conform to the requirements of this Contract. If the City's <br />Representative deems it necessary or advisable, the City's Representative shall have <br />authority to require additional inspection or testing of the Work for compliance with <br />Contract requirements.
