The Contractor further acknowledges and represents that it has made a thorough and careful examination and inspection of existing above ground surface conditions on the Project site, and the Contractor expressly acknowledges and agrees that it shall make no claim for additional compensation due to existing above ground surface conditions that could be determined or ascertained from a thorough and careful above ground examination and inspection of the site. 1.5.9 In the event of any conflict in the Contract Documents, the following documents shall take precedence in the following order of precedence: (a) any Change Orders; (b) the Addenda; (c) the Specifications; (d) the Drawings; (e) any Supplemental Conditions; (f) the Contract for Construction; (g) the City's Bid; (h) the Contractor's Representations made at the Post -bid Conference; (i) the Contractor's Response As between numbers and scaled measurements on the Drawings, the numbers shall govern; as between larger scale and smaller scale drawings, the larger scale shall govern. 1.5.10 Neither the organization of any ' of the Contract Documents into divisions, sections, paragraphs, articles, (or other categories), nor the organization or arrangement of the Design, shall control the Contractor in dividing the Work or in establishing the extent or scope of the Work to be performed by Subcontractors. 1.5.11 Whenever the word "days" is used, it shall mean calendar days and not working days unless otherwise specified. 1.5.12 Contractor shall comply with Section 255.04, Florida Statutes, in selecting subcontractors, materials and suppliers. 1.6 Ownership of Contract Documents 1.6.1 The Contract Documents, and each of them, shall remain the property of the City unless the City has agreed otherwise with the City's Representative and/or City Consultant Engineer. The Contractor shall have the right to keep one record set of the Contract Documents upon completion of the Project; provided, however, that in no event shall Contractor use, or permit to be used, any or all of such Contract Documents on other projects without the City's prior written authorization. 1.7 Public Records Law COMTECH ENGINEERING, INC. 4
