REQUESTS <br />1. Pursuant to Sections §265-13 and §265-14 of the City of Sunny Isles Beach Land <br />Development Regulations, the Applicant is requesting approval of conditional use for <br />an off -site temporary sales center. <br />2. Pursuant to Section §265-18 of the City of Sunny Isles Beach Land Development <br />Regulations, the Applicant is requesting site plan approval for a one-story temporary <br />sales center with 4,480 square feet of floor area. <br />3. Pursuant to Section §265-35 of the City of Sunny Isles Beach Land Development <br />Regulations, the Applicant is requesting a variance to reduce the north side setback <br />from 20' to 11'. <br />4. Pursuant to Section §265-57 of the City of Sunny Isles Beach Land Development <br />Regulations, the Applicant is requesting the use of murals and graphics on a <br />temporary construction fence. <br />IV. CONDITIONAL AND TEMPORARY USE REVIEW <br />The Temporary Use Code Section §265-14.B. states that a temporary sales center which <br />is located off -site from the development project that it is supporting must be treated as a <br />conditional use and therefore requires review and approval by the City Commission. The <br />following analysis compares the proposed temporary sales center use against the <br />Conditional Use review criteria of Code Section §265-13.(C): <br />(1) The proposed use shall be consistent with the Comprehensive Plan. <br />(2) The establishment, maintenance or operation of the proposed use shall not be <br />detrimental to or endanger the public health, safety, or general welfare. <br />(3) The proposed use shall be consistent with the community character of the <br />immediate neighborhood of the proposed use. <br />(4) Utilities, roadway capacity, drainage, and other necessary public facilities, <br />including police, fire and emergency services, shall exist at the City's adopted <br />levels of service, or will be available concurrent with demand as provided for in <br />the requirements of these LDRs. <br />Page 3 of 12 <br />347 <br />
