Section Exceptions Exceptions to the RFPLoss, Theft & Vandalism Responsibility <br />Due to the nature, scale, and public accessibility of the holiday lighting and décor installations, Miami Holiday Lights requests <br />the following exception and clarification to the RFP terms: <br />The Client shall be responsible for any loss, theft, vandalism, or intentional damage to holiday décor, lighting systems, <br />electrical components, specialty displays, or related event infrastructure occurring after installation and acceptance of the <br />displays. <br />While Miami Holiday Lights will provide routine maintenance and repair services as outlined within the agreement, repairs or <br />replacements resulting from: <br />Theft <br />Vandalism <br />Intentional destruction <br />Vehicle impact <br />Public misuse <br />Extreme abuse or negligence by third parties <br />shall be considered outside normal maintenance coverage. <br />In order to maintain the visual quality and operational continuity of the event and holiday displays, Miami Holiday Lights will <br />make commercially reasonable efforts to replace damaged or stolen materials as inventory and product availability allow. Any <br />replacement labor, materials, equipment, shipping, fabrication, or emergency service costs associated with such incidents <br />shall be billed as an additional service to the Client at agreed-upon rates. <br />Miami Holiday Lights recommends: <br />Adequate overnight security <br />Surveillance monitoring where applicable <br />Coordination with local law enforcement <br />Controlled access to high-value installations <br />to minimize exposure to theft, vandalism, and public damage during the installation period. <br />RFP 26-04-01 – Citywide Holiday Lighting & Decorating…91
