ADDENDUM TO MASTER SERVICES AND PURCHASING AGREEMENT WITH AXON ENTERPRISE, INC. THIS ADDENDUM between the CITY OF SUNNY ISLES BEACH, Florida (hereinafter "CITY") and AXON ENTERPRISE, INC., a foreign corporation authorized to do business in the State of Florida, whose Federal Employer Identification (FEI) Number is 86- 0741227 (hereinafter "AXON"), executed July � 00t, 2026, is made a part of the AXON Master Services and Purchasin Agreement and Quote (hereinafter "Agreement") between CITY and AXON, dated July 2026. CITY and AXON hereby agree as follows: The following sections are added to the Agreement: 19.13. PUBLIC RECORDS. AXON shall be required to comply with the following requirements under Florida's Public Records Law: A. AXON shall keep and maintain public records required by the CITY to perform the service. B. Upon written request from the CITY, AXON shall provide the CITY with a copy of the requested records or allow the records to be inspected or copied within a reasonable time at a cost that does not exceed the cost provided by Chapter 119, Florida Statutes, or as otherwise provided by law. C. AXON shall ensure that public records that are exempt or confidential and exempt from public records disclosure requirements are not disclosed except as authorized by law for the duration of the contract term and following completion of the contract if AXON does not transfer the records to CITY. D. Upon written request, AXON shall, upon completion of the contract, transfer, at no cost, to the CITY all public records in possession of AXON or keep and maintain public records required by CITY to perform the service. If AXON transfers all public records to CITY upon completion of the contract, AXON shall destroy any duplicate public records that are exempt or confidential and exempt from public records disclosure requirements. If AXON keeps and maintains public records upon completion of the contract, AXON shall meet all applicable requirements for retaining public records. All records stored electronically must be provided by AXON to CITY, upon written request from CITY in a format that is compatible with the information technology systems of CITY. Notwithstanding the above, neither party shall be required to erase, delete, alter or destroy back-up media made in the ordinary course of business.
