HUD also <br />provides sample language for JointAgreements in ATTACHMENT 4. <br />NOTE: If either your Urban County or the Metropolitan City falls under the "exception criteria" at 24 CFR <br />570.208(a)(1)(ii) for activities that benefit low- and moderate -income residents of an area, your Urban County <br />must notify the Metropolitan City in a letter of the potential effects of Joint Agreements on these activities. <br />3.6 What are HUD's requirements for County Counsel Legal Opinion Letters? <br />You must submit a legal opinion from your county counsel's office (office of the "chief <br />legal official" for your county) in an official letter. HUD will accept letters issued by your <br />county's Office of County Counsel, Office of General Counsel, or similarly named office. <br />HUD will also accept letters signed by an attorney who is not the "chief legal official," <br />such as your Depply County Counsel or Legal Branch Chief. This legal opinion letter <br />must state two things: 1) that state and local law authorizes the terms and provisions of <br />your Cooperation Agreements with Participating UGLGs and/or Joint Agreements with <br />Metropolitan Cities (Joint Recipients) AND 2) that the agreements provide full legal <br />authority for your county to undertake, or assist in undertaking, essential community <br />development and housing assistance activities in incorporated areas. <br />3.7 What is HUD's new policy on "auto -renewal" of Cooperation Agreements and <br />JointAgreements (effective for the FY 2027 Urban County qualification process)? <br />3.7.1 Background and history on "auto -renewal" of Urban County agreements <br />In the past, HUD allowed Urban Counties and partnering local governments to <br />"auto -renew" their Urban County agreements (Cooperation Agreements and Joint <br />Agreements) in perpetuity by adding an auto -renewal provision to their agreements. <br />Urban Counties and partnering local governments would only make amendments <br />to their agreements if required by HUD (in a new Urban County Notice) or <br />because new federal, state, or local laws necessitated updating the agreements. <br />20 <br />576 <br />
