RESOLUTION NO. 2026 - -4Qg9 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, <br />FLORIDA, APPROVING A FIRST AMENDMENT TO THE AGREEMENT WITH <br />ENVIROWASTE SERVICES GROUP, INC. FOR STORMWATER MANAGEMENT <br />PREVENTATIVE MAINTENANCE SERVICES, IN AN AMOUNT NOT TO EXCEED <br />TWO HUNDRED FIFTY THOUSAND DOLLARS AND NO CENTS ($250,000.00); <br />ATTACHED HERETO AS EXHIBIT "A"; AUTHORIZING THE MAYOR TO EXECUTE <br />SAID AGREEMENT; AUTHORIZING THE CITY MANAGER TO DO ALL THINGS <br />NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE <br />DATE. <br />WHEREAS, on November 7, 2024, the City issued and advertised Invitation to Bid No. <br />25-11-01 (the `Bid") for stormwater management preventative maintenance services ("the <br />Services") and received six (6) submissions; and <br />WHEREAS, on January 16, 2025, via Resolution No. 2025-3787, the City Commission <br />awarded the Bid, and approved an Agreement with, National Water Main Cleaning Co. <br />("NWMC") as the Primary Awardee, in an amount not to exceed $300,000.00; and <br />WHEREAS, on January 16, 2025, via Resolution No. 2025-3788, the City Commission <br />awarded the Bid, and approved an Agreement with, EnviroWaste Services Group, Inc. <br />("Envirowaste") as the Secondary Awardee, in an amount not to exceed $100,000.00, to ensure <br />continuity of services in the event NWMC defaulted on its contractual obligations; and <br />WHEREAS, on May 21, 2026, NWMC notified the City of its decision to cease operations <br />in Florida and has requested termination of its contract; and <br />WHEREAS, the City accepted the request and has terminated the Agreement with <br />NWMC; and <br />WHEREAS, as a result of the termination, the City wishes to activate the Agreement with <br />EnviroWaste to provide the City with the desired services; and <br />WHEREAS, Envirowaste has the requisite qualifications, expertise, and licenses to <br />perform all necessary work in connection with the Services specified in the Bid; and <br />WHEREAS, the City Commission wishes to approve a First Amendment to the Agreement <br />with Envirowaste to provide the Services, in an amount not to exceed Two Hundred Fifty <br />Thousand Dollars and No Cents ($250,000.00), bringing the total agreement to an amount not <br />to exceed Three Hundred Fifty Thousand Dollars and No Cents ($350,000.00), attached hereto <br />as Exhibit "A". <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY <br />ISLES BEACH, FLORIDA, AS FOLLOWS: <br />@BCL@7C152A89 Page 1 of 2 479 <br />
