Summary Minutes:Regular City Commission Meeting February 19,2015 City of Sunny Isles Beach,Florida <br /> and it is coming back to haunt us. We created a terrible situation for LaPerla years ago and it <br /> has come back to haunt us. He feels like we have an obligation when we can in a future <br /> Commission to try to fix those things if we can, at least if we have a reasonable proposal in <br /> front of us that might create some frustration for folks but it cures a major ill. <br /> Commissioner Aelion asked Architect Castineira what is the height differential between the <br /> new height and the top of the railing outside close to the swimming pool, and Architect <br /> Castineira said it is even. Commissioner Aelion said every building has its own security,and <br /> this is a common element and a person from one Tower goes to the other,have you accounted <br /> for that, the privacy issue for each building? Architect Castineira said the decks are going to <br /> be unified from both Towers and they will be able to share the new common area. The <br /> building itself is also common space and in the parking decks you communicate through the <br /> whole pedestal as it exists right now and so it is no different than that. Mayor Scholl said the <br /> lanai has a natural break, and Architect Castineira said it is open and can be walked across. <br /> Attorney Mars said there is a plaza area currently on the lower level and we are just raising it <br /> and making it the same level. He understands your security concern but it is the same security <br /> that currently exists, it is just now going to flow differently. Commissioner Levin said when <br /> she first learned about this issue,the first thing that occurred to her was thatit was a bad policy <br /> to allow the parking buy-down, and she believes that they do have the right to have quiet <br /> enjoyment of their premises and this is a big part of it. Obviously the adding of the additional <br /> parking spaces, the change of the structure, and adding all of these additional amenities will <br /> increase the property values which would bring more taxes to the City. <br /> Commissioner Aelion moved and Commissioner Levin seconded a motion for approval, <br /> subject to staff conditions. Resolution No. 15-Z-150 was adopted by a roll call vote of 4- <br /> 1 [Vice Mayor Gatto against] in favor. <br /> Vote: Commissioner Aelion yes <br /> Commissioner Goldman yes <br /> Commissioner Levin yes <br /> Vice Mayor Gatto no <br /> Mayor Scholl yes <br /> [City Clerk's Note: The Commission took a ten-minute recess after hearing Item 6,4.] <br /> 7. ORDINANCES FOR FIRST READING <br /> 7A. An Ordinance of the City Commission of the City of Sunny Isles Beach, Florida, Amending <br /> Ordinance No. 2014-436;Amending the City's Budget No.BA1415-02 for the 2014-2015 <br /> Fiscal Year—General Fund,Street Maintenance&Construction Fund,Building Fund, <br /> Capital Fund, 2011 Capital Projects Fund, 2010 Capital Projects Fund, Stormwater <br /> Fund and Stormwater Capital Fund; Authorizing the City Manager to Do All Things <br /> Necessary to Implement the Terms and Conditions of this Ordinance; and Providing for an <br /> Effective Date. <br /> Action: City Clerk Hines read the title, and Finance Director Audra Curts-Whann reported <br /> that the budget is being amended in conjunction with the Audit Report. Upon conclusion and <br /> receipt of our Annual Audit we have the ending final September 30, 2014 fund balances to <br /> 12 <br />
