Summary Minutes:Regular City Commission Meeting February 19,2015 City of Sunny Isles Beach,Florida 7D. An Ordinance of the City Commission of the City of Sunny Isles Beach, Florida, Amending Section 150-1 of the Code of Ordinances ("Materials and Color of Exterior Walls")to Update the Color Palette for Exterior Walls of Structures; Providing for Severability; Providing for Inclusion in the Code; Providing for Repeal of Conflicting Provisions; and Providing for an Effective Date. Action: City Clerk Hines read the title, and Planning and Zoning Administrator Claudia Hasbun reported that this is to update our Color Palette from Sherwin Williams. Public Speakers: None Commissioner Aelion said he is uncomfortable with the singular use of a contractor. Ms. Hasbun said that the Code actually allows that flexibility as long as it is appropriate with the color palette we can allow other providers. Commissioner Aelion moved and Vice Mayor Gatto seconded a motion to approve the proposed Ordinance on first reading. The motion was approved by a roll call vote of 5- 0 in favor. Second reading, public hearing will be held on Thursday, March 19,2015, at 6:30 p.m. Vote: Commissioner Aelion ves Commissioner Goldman ves Commissioner Levin ves Vice Mayor Gatto ves Mayor Scholl ves 7E. An Ordinance of the City Commission of the City of Sunny Isles Beach, Florida, Amending Section 265-5 of the City Code Entitled"Definitions"to Include Public Parks Managed by Miami-Dade County and the State of Florida in the Definition of Public Parks; Providing for Severability; Providing for Repealer; Providing for Inclusion in the Code; Providing for an Effective Date. Action:City Clerk Hines read the title,and City Attorney Ottinot reported that under the City Code we have a need to clarify the definition of a Park. We have one public Park that is owned by the State that is considered a Park in our Comprehensive Plan which is the beach. Adjacent to that is Haulover Park which is operated by the State. Public Speakers: None Mayor Scholl said the issue is our Code at times speaks to adjacency to parks, and this Park would not have technically qualified as an adjacency and we are making sure that it does. Vice Mayor Gatto moved and Commissioner Levin seconded a motion to approve the proposed Ordinance on first reading. The motion was approved by a roll call vote of5- 0 in favor.
