(E) Failure to follow the protest procedures set forth herein shall automatically nullify any protest <br /> or claim brought by an aggrieved bidder, offeror or contractor. <br /> ARTICLE 9. ETHICS IN PUBLIC CONTRACTING <br /> In addition to all ethical rules and guidelines set forth by the Commission on Ethics and the <br /> Miami-Dade County Code, as applicable to the City of Sunny Isles Beach and t}ie State of Florida, <br /> the City Manager may impose any one or more of the following sanctions on a City Employee for <br /> violations of ethical standards set forth by Miami-Dade County or the State of Florida including,but <br /> not limited to: oral or written warnings or reprimands,suspension with or without pay for specified <br /> periods of time or termination of employment. For non-employees, for violations of ethical <br /> standards,the City Commission may terminate any contract with the City of Sunny Isles Beach. <br /> ARTICLE 10. REPEAL OF CONFLICTING PROVISIONS. <br /> All provisions of the Code of Metropolitan Dade County as made applicable to the City by <br /> Article VIII, Sections 8.3 of the City Charter and Ordinance 97-10 which are in conflict with this <br /> Ordinance are hereby repealed. <br /> ARTICLE 11. SEVERABILITY. <br /> The provisions of this Ordinance are declared to be severable and if any section, sentence, <br /> clause or phrase of this Ordinance shall for any reason be held to be invalid or unconstitutional,such <br /> decision shall not affect the validity of the remaining sections,sentences,clause's and phrases of this <br /> Ordinance but they shall remain in effect, it being the legislative intent that this Ordinance shall <br /> stand notwithstanding the invalidity of any part. <br /> ARTICLE 12. INCLUSION IN THE CODE. <br /> It is the intention of the City Commission,and it is hereby ordained that the provisions of this <br /> Ordinance shall become and made a part of the City of Sunny Isles Beach Code;lthat the sections of <br /> this Ordinance may be renumbered or re-lettered to accomplish such intentions; and that the word <br /> "Ordinance" shall be changed to "Section" or other appropriate word. <br /> ARTICLE 13.
