2. All conditions set forth in City Resolution No. 14-Z-141 approved and adopted on July 17; <br />2014 shall remain in effect except conditions modified in this approval. <br />3. Upon the submittal of an application for building permit, the plans submitted shall meet <br />with the approval of the Community Development Department and be consistent with the <br />specific site plan approved by the City Commission. Plans shall include all the required <br />elements of the site plan pursuant to the Citv's Land Development Regulations and <br />recommendations. Should compliance with recommendations result in a change that <br />would not be considered "minor' in accordance with Section 265-18 of the City Code. the <br />Applicant shall be required to obtain another approval of the City Commission. <br />4. That in the event of multiple ownership, a homeowner's association shall be established in <br />accordance with applicable regulations to assure that all common areas and facilities for <br />the residents. as well as all easements dedicated to the City. shall be maintained in <br />continuous and satisfactory manner and without expense to the general taxpayers of the <br />City of Sunny Isles Beach. <br />5. If approved. the Applicant shall submit a separate building permit prior to any installation <br />of murals or graphics on temporary construction fencing to be approved administratively <br />by the City Manager or his designee. <br />6. That the Applicant shall comply with all conditions and permit requirements. including but <br />not limited to Miami -Dade County; including environmental conditions and permitting. the <br />Fire and Water and Sewer Departments, Florida Department of Environmental Protection <br />(DEP) and Florida Department of Transportation (FDOT). <br />7. The Applicant shall coordinate and work with Miami -Dade County Traffic Engineering <br />Department and the City of Sunny Isles Beach to develop strategy in order to provide <br />modified and acceptable signal timing plans. The Applicant must take the necessary steps <br />to pursue the signal timing changes consistent with the proposed signal timing plans (i.e. <br />optimized) as documented in the traffic study. <br />S. That the Applicant shall address comments provided by City's Landscaping Architect <br />regarding landscaping plans submitted during site plan review process. <br />9. That the Applicant shall address comments provided by City's Traffic Engineer regarding <br />traffic plans submitted during site plan review process. <br />10. That the Applicant shall address comments provided by City's Civil Engineer regarding <br />Civil plans submitted during site plan review process. <br />11. That the Applicant shall be responsible for undergrounding all utility lines along 183th <br />Street to the eastern border of their property. The Applicant further agrees to provide the <br />City with an escrow deposit of Two Hundred Thousand Dollars (5200.000.00) for the cost <br />of undergrounding the utility lines located adjacent to the gas station located on their <br />property. If the costs of undergrounding the utility lines adjacent to the gas station exceed <br />15-Z-_ Publix Super Markets. Inc. 4 <br />
