Summary Minutes:Regular City Commission Meeting January 21,2016 City of Sunny Isles Beach,Florida Commissioner Levin said so it is the receiving site, and Mayor Scholl said right, it is the financiers of the receiving site, and he would have pulled it if he didn't think that we were 99% of the way there. All of this was going on today, and so City Attorney Ottinot has an Escrow Agreement whereby when they get that approval but his caveat was is it 20 days or two weeks? City Attorney Ottinot said right now it is 20 days. Mayor Scholl said we are going to accept the donation of the property, we are going to issue the TDRs, and then we also agree to the cash payment. They are also going to provide the City with a cash payment in the amount of$437,000.00 within 21/4 years, and so we are getting some money back in addition to conveying the TDRs, it is a little complex. Mayor Scholl said when we close on this land we will get immediate control of it. In other deals that we have done,sometimes we allow the property owner to maintain use of the land for a year or two like we are doing for Tumberry, like we did for Dezer and the Dezer Platinum piece. This owner is making a deal with the Dezers to sublease the Platinum piece for the remainder of our term that we granted the Dezers with another 2%2 years. They asked if they were still needing it,and only if they need it for the sale of the Ritz Carlton project, if they could lease it from the City for another year, up to 18 months past the expiration of the Dezers lease which we agreed to because we are getting this property immediately. That is the difference, if we did it the normal way we would still have the Dezer piece tied up and this piece would be tied up for potentially two or three years. Frankly, it cleans up the south end too because they won't be building a sales center and knocking it down to build a building, it will be across the street. Commissioner Aelion said eventually that property goes to the City, and Mayor Scholl said actually we already own it,they donated that site and we gave them TDRs, and they used those TDRs for the Armani building. Vice Mayor Gatto congratulated Mayor Scholl on his negotiating skills because this is amazing, if you look at all the components involved down to the Dezer's Sales Office, and have this all completely fall into place where we avoided having an office building sticking out in the middle of a residential area. She just wanted to make sure everyone appreciates the effort that was done to maintain the integrity of the Golden Shores area. Commissioner Aelion moved and Commissioner Levin seconded a motion to approve the resolution. Resolution No. 2016-2511 was adopted by a voice vote of 5-0 in favor. 10F. A Resolution of the City Commission of the City of Sunny Isles Beach, Florida, Approving and Accepting a Warranty Deed for the Conveyance of Land for Public Purposes from Corner House, LLC; Authorizing the Recording of the Deed in the Public Records of Miami-Dade County, Florida; Authorizing the City Manager and City Attorney to Do All Things Necessary to Effectuate the Terms of this Resolution; Providing for an Effective Date. Action: [City Clerk's Note: Item 10F was heard with related Items 10D, 10E and 10G.] City Clerk Hines read the title, and Mayor Scholl reported.
