Shell Sign Variance III. History The Applicant is replacing an existing pole sign with a proposed monument sign to comply with the City's Sign Code, prohibiting pole mounted signs in the City. The proposed monument sign does not meet Code Section 265-56A(5), requiring a minimum side setback of20 feet. Plans are on file and may be examined in the Planning and Zoning Department for "Motiva Enterprises, LLC." entitled "Shell Oil Products - Proposed Signage Site Plan", including cover sheet prepared by MOM Services, Inc. Engineering & Environmental consisting of I sheet dated stamped received 05-07-07 and plans entitled "Shell Monument Sign", consisting of I sheet prepared by Federal Heat Sign Company dated 06-01-06. IV. Section 265-63.1 Sign Ordinance Variance It is recognized that the regulations provided herein cannot address all situations pertaining to signs. The City Commission is, therefore, empowered to grant variances from the provisions of the chapter upon filing of a variance application with the Plamling and Zoning Department. The application for a variance may be granted if the City Commission finds that the Applicant has satisfied the criteria set forth in Section 265-63.1 of the City Code. Applicant response: There is only one (I) landscaping area at this Shell Station large enough to accommodate these requirements. This is the location where the original Shell Pole mounted price sign is/was located. This sign must be replaced with a smaller low level monument style sign to meet the current city sign ordinance. It is not possible to meet the current side setback requirement and remain within the existing landscaped area. It is also not feasible to increase the planter area because it would encroach further into the existing driveway and also interfere with safe, internal traffic flow. EDC Z2001-0S 2 20
