<br />Shell Sign Variance <br /> <br />The granting of this variance to allow the new monument sign to be installed in the same location as <br />the existing sign would in no way be detrimental to the health, safety or welfare of the residents of <br />Sunny Isles Beach, and would allow the Shell Station to continue business as previously conducted. <br />It would cause Shell an extreme hardship to redesign and re-build the existing facility to <br />accommodate changing a sign location that currently exists. <br /> <br />The new low-level monument sign will be more pleasing to the overall appearance of the Shell <br />Station, the motoring public, and residents of Sunny Isles Beach. <br /> <br />V. Staff Analysis of Request <br /> <br />The variance request is submitted to comply with the new Sign Code requirement prohibiting signs <br />mounted on poles in the City. The owner has removed the illegal pole sign and intents to replace it <br />with a new monument sign to meet this requirement. The proposed monument sign will contain the <br />Shell logo as well as the price per gallon of each type of motor fuel available for sale, as required by <br />the Miami-Dade County Business Regulations Ordinance Section 8A-4, Gasoline Price Signs. It is <br />important to note that the Applicant will be allowed to use a temporary sign if the variance <br />is not granted. The temporary sign is pennitted under the County Code to alert customers <br />of gas prices <br /> <br />The gas station site is constrained as to the location of a ground monument sign. Due to the existing <br />vehicular use areas, there is limited space to locate a monument sign and meet the side setback <br />requirement of 20 feet (applicant is providing 9 feet 8 inches from the side property line). <br />Additionally, the sign must meet the site distance triangle requirements to ensure vehicles safety <br />while entering and exiting the property. The proposed location of the sign would cause no safety <br />issue, nor be a detriment to adjacent properties. <br /> <br />VI. Conditions <br /> <br />Conditions to be comoIeted before buildinl! oermits are issued. <br /> <br />I) That the project shall be developed substantially in accordance with the plans submitted for public <br />hearing. Plans are on file and may be examined in the Planning and Zoning Department entitled <br />"Shell Oil Products - Proposed Signage Site Plan", including cover sheet prepared by MOM <br />Services, Inc. Engineering & Environmental consisting of one <I) sheet dated stamped received <br />05-07-07 and plans entitled "Shell Monument Sign", consisting of one sheet prepared by Federal <br />Heat Sign Company dated 06-01-06. Plans may be modified at public hearing <br /> <br />EDC Z2OO7-05 <br /> <br />3 <br /> <br />21 <br />
