a. The Building Unit 3 have as its perimetrical boundaries, the <br /> unfinished portions of the interior walls of the Building Unit 3 <br /> extended to their planar intersections with each other and with <br /> the lower ground floor boundary, except for that portion of the <br /> interior wall that intersects with Building Unit 1 and Building <br /> Unit 2, in which case, that section shall extend to their planar <br /> intersections with Building Unit 1 and Building Unit 2. The <br /> upper horizontal boundaries of the Building Unit 3 shall be the <br /> air space located above the fourth floor garage space as <br /> depicted on Exhibit "1". It being specifically intended that all <br /> of floor level three and four shall be within and part of <br /> Building Unit 3, and all of floor level 2 shall be within and part <br /> of Building Unit 3, less and except for that portion which shall <br /> serve as the upper boundaries of Building Unit 1 and Building <br /> Unit 2. <br /> b. The Land Unit 3 perimetrical boundaries shall be as set forth <br /> on Exhibit "1". <br /> c. The Land Unit 3 upper and lower boundaries shall be <br /> determined in the same manner and under the same laws which <br /> establish the upper and lower boundaries of a parcel of land, <br /> title to which is held in fee simple. <br /> (3) Where there are apertures in any boundary, including, but not <br /> limited to windows, loading bays, doors, skylights, balconies and porches, such <br /> boundaries shall be extended to include the windows, loading bay, doors, <br /> skylights and other fixtures located in such apertures, including all frameworks <br /> thereof. <br /> (4) In the event that the actual physical location of any Unit <br /> constructed within the Buildings at any time does not precisely coincide with the <br /> area depicted on the Condominium Plat, the actual physical location of the Unit <br /> shall control over locations, dimensions and descriptions reflected on the Plot <br /> Plan. <br /> D. Limited Common Elements. Certain Common Elements may been <br /> designated as Limited Common Elements, reserved for the use of a particular Unit or <br /> Units, to the exclusion of other Units. The Limited Common Elements and the Units to <br /> which their use has been designated are as described herein below and as further <br /> identified on the Plot Plan attached hereto as Exhibit "1". The exclusive use of a Limited <br /> Common Element is appurtenant to the Unit or Units to which it is designated or <br /> assigned. The right to such use shall pass with the Unit on transfer, whether or not <br /> separately described, and cannot be separated from it. <br /> The following Common Elements are hereby designated as Limited Common <br /> Elements: <br /> 8 <br />
