designation. The legal description of each Unit shall be the word "Unit," followed by the <br /> identifying number, followed by "Gateway Park Condominium, a commercial <br /> condominium." <br /> I. Changes to Units. <br /> (1) Except as otherwise reserved by Developer, no Unit Owner shall <br /> make any alteration or improvement to such Owner's Unit except in accordance <br /> with this Section. Unit 1 and Unit 2 Owners may make alterations and <br /> improvements to the interior of the said Unit 1 or Unit 2 so long as such <br /> alterations or improvements are not visible from the outside of the Unit 1 or Unit <br /> 2 or the Buildings, do not impair the structural integrity of the Unit or the <br /> Buildings, do not otherwise violate the terms of this Declaration, and are in <br /> compliance with all applicable building codes and laws. Each Owner shall have <br /> the right, at his own cost and expense, alter or substitute any plumbing, electrical <br /> or other such fixtures attached to said ceilings, floors or walls; provided that this <br /> provision shall not be construed as permitting interference with the use and <br /> enjoyment of the Common Elements by other Owners and are in compliance with <br /> all applicable building codes and laws. Other alterations or improvements to a <br /> Unit which are not discussed in this Declaration may be made only if prior <br /> approval in writing is obtained from the Board of Directors. <br /> (2) Unit 3 Owner may make alterations and improvements to the <br /> interior or exterior of the said Unit 3 so long as such alterations or improvements <br /> do not impair the structural integrity of the Unit or the Buildings, do not otherwise <br /> violate the terms of this Declaration, and are in compliance with all applicable <br /> building codes and laws. Other alterations or improvements to a Unit which are <br /> not discussed in this Declaration may be made only if prior approval in writingis <br /> obtained from the Board of Directors. <br /> (3) Developer shall have the additional right, without the consent or <br /> approval of the Board of Directors or other Unit Owners, to make alterations, <br /> additions or improvements, structural and non-structural, interior and exterior, <br /> ordinary and extraordinary, in, to and upon any Unit owned by it, to the proposed <br /> or already constructed Unit located or to be located thereon, and Limited <br /> Common Elements appurtenant thereto. Such modifications shall include, without <br /> limitation: (i) the removal of walls, floors, ceilings and other structural portions of <br /> the Unit; and (ii) changes to the layout or number of rooms in any Developer- <br /> owned Units. <br /> 5. OWNERSHIP SHARES, COMMON ELEMENTS AND COMMON SURPLUS. <br /> A. Calculation. The undivided share in the Common Elements and Common <br /> Surplus appurtenant to each Unit, as well as the undivided share of the Common Expenses to be <br /> paid with respect to each Unit, has been established by Developer in the following manner: <br /> 10 <br />
