an action to recover sums for damages, an action for injunctive relief, or any combination <br /> thereof <br /> C. Fines. In addition to all other remedies, in the sole discretion of the Board <br /> of Directors of the Condominium Association, a fine or fines may be imposed upon a <br /> Unit Owner for failure of a Unit Owner, his tenants, family guests, invitees, or employees <br /> to comply herewith or with any rules or regulations <br /> G. Non-Exclusive Remedy. The fines provided for herein shall not be <br /> construed to be an exclusive remedy of the Condominium Association, and shall exist in <br /> addition to all other rights and remedies to which the Condominium Association may be <br /> otherwise legally entitled; however, any penalty paid by the offending Unit Owner shall <br /> be deducted from or offset against any damage which the Condominium Association may <br /> otherwise be entitled to recover by law. <br /> 21. MISCELLANEOUS: <br /> A. Severability. The invalidity in whole or in part of any covenant or <br /> restriction, or any section, subsection, sentence, clause, phrase or word, or other provision <br /> of this Declaration of Condominium, Articles of Incorporation of the Condominium <br /> Association, the Bylaws and rules and regulations of the Condominium Association shall <br /> not affect the validity of the remaining portions. <br /> B. Applicable law. The validity, application and construction of this <br /> Declaration and its Exhibits shall be governed by the laws of the State of Florida. <br /> C. Conflicts. If there is a conflict between any provision of this Declaration <br /> and the Condominium Association's By-Laws or Articles of Incorporation, the <br /> Declaration shall control. <br /> D. Interpretation. The Board of Directors of the Condominium Association <br /> shall be responsible for interpreting the provisions of this Declaration and of any of the <br /> exhibits attached hereto. Such interpretation shall be binding upon all parties unless <br /> wholly unreasonable. A written opinion rendered by legal counsel that an interpretation <br /> adopted by the Board is not unreasonable shall conclusively establish the validity of such <br /> interpretation. <br /> E. Exhibits. There is hereby incorporated within this Declaration any <br /> materials contained in the exhibits attached hereto. <br /> 23 <br />
