DECLARATION OF CONDOMINIUM <br /> OF <br /> GATEWAY PARK CONDOMINIUM <br /> a Commercial Condominium <br /> This Declaration of Condominium is made this 27th day May, 2016, by CITY OF <br /> SUNNY ISLES BEACH, a Florida municipal corporation, herein called the Developer, for <br /> itself, its successors, grantees and assigns. <br /> WHEREIN, the Developer makes the following declarations: <br /> 1. LAND - NAME - SUBMISSION STATEMENT: <br /> A. The Land. The land owned by Developer, which, by this instrument, is <br /> submitted to the condominium form of ownership, is the land lying in Miami-Dade <br /> County, Florida, (subject to easements, restrictions and reservations of record), which is <br /> described as follows: <br /> See Exhibit "A" attached. <br /> B. Name. The name by which this condominium is to be identified is <br /> GATEWAY PARK CONDOMINIUM, a commercial condominium. <br /> C. Submission Statement. Developer hereby submits the real property as <br /> described on Exhibit "A", and all improvements erected thereon, all easements, rights <br /> and appurtenances belonging thereto, and all other property, located thereon and intended <br /> for use in connection therewith, to the condominium form of ownership and uses the <br /> lands described in this instrument and improvements now and hereafter on such lands. <br /> 2. DEFINITIONS: Capitalized terms used in this Declaration and in its exhibits have the <br /> meanings stated as follows unless the context otherwise requires: <br /> A. Articles or Articles of Incorporation. The Articles of Incorporation of the <br /> Condominium Association, as may be amended from time to time attached hereto as <br /> Exhibit "B". <br /> B. Assessment. A share of the funds required for the payment of Common <br /> Expenses, which from time to time are assessed against a Unit and the Owner of a Unit. <br /> C. Condominium Association. Gateway Park Commercial Condominium <br /> Association, Inc., a Florida non-profit corporation and its successors. <br /> E. Board of Directors or Board.
