O. Declarant or Developer. Means and refers to The City of Sunny Isles <br /> Beach, a Florida municipal corporation. It shall not include any person or entity who <br /> purchases or who acquires by any means, a Condominium Unit from Developer unless <br /> such purchaser is specifically assigned some or all rights of Developer by a separate <br /> recorded instrument. <br /> P. Declaration or Declaration of Condominium. This instrument creating this <br /> Condominium as it may be from time to time amended. <br /> Q. Institutional Mortgagee. The holder of a first mortgage against a Unit <br /> which holder is a bank, savings and loan, real estate or mortgage investment trust, <br /> pension or profit sharing trust, any agency of the United States of America, or any entity <br /> recognized in the community as an institutional lender. A mortgage may be placed <br /> through and closed in the name of a mortgage broker. <br /> R. Limited Common Elements. Limited Common Elements means and <br /> includes those Common Elements which are reserved for the use of a certain Unit or <br /> Units, to the exclusion of other Units, as specified in this Declaration of Condominium. <br /> S. Member. Those Owners who are members of the Condominium <br /> Association. <br /> T. Owner or Unit Owner. An owner of an interest in one or more Units to <br /> the extent of such interest. The term Owner or Unit Owner shall not mean or refer to any <br /> mortgagee unless and until any such mortgagee has acquired title pursuant to foreclosure <br /> or any proceeding in lieu of foreclosure. <br /> U. Property or Properties. The real property submitted to the condominium <br /> form of ownership pursuant to the terms hereof. <br /> V. Surface Water or Stormwater Management System. A system which is <br /> designed and constructed or implemented to control discharges which are necessitated by <br /> rainfall events, incorporating methods to collect, convey, store, absorb, inhibit, treat, use <br /> or reuse water to prevent or reduce flooding, overdrainage, environmental degradation, <br /> and water pollution or otherwise affect the quantity and quality of discharges. <br /> W. Voting Interests. The arrangement established in this Declaration as set <br /> forth on Exhibit "D" attached hereto, and the Bylaws, by which the Owner of a Unit is <br /> entitled to vote in Condominium Association matters. <br /> Whenever the context so permits, the use of plural shall include the singular, the <br /> singular the plural, and the use of one gender shall include all genders. <br /> 3.
