ORDINANCE NO. 2016- <br /> AN ORDINANCE OF THE CITY COMMISSION OF THE CITY <br /> OF SUNNY ISLES BEACH, FLORIDA, AMENDING CHAPTER <br /> 238 OF THE CODE OF ORDINANCES OF THE CITY OF <br /> SUNNY ISLES BEACH TO ADD A NEW SECTION 238-16 <br /> REGULATING WORK WITHIN THE CITY OF SUNNY ISLES <br /> BEACH RIGHTS-OF-WAY; PROVIDING FOR STANDARDS <br /> FOR CONSTRUCTION AND REPAIRS OF STREETS WITHIN <br /> THE BOUNDARIES OF THE CITY; PROVIDING FOR <br /> SUSPENSION OF PERMIT; PROVIDING FOR EXCEPTIONS; <br /> PROVIDING FOR SEVERABILITY; PROVIDING FOR <br /> INCLUSION IN THE CODE; PROVIDING FOR REPEALER; <br /> PROVIDING FOR AN EFFECTIVE DATE. <br /> WHEREAS, the City of Sunny Isles Beach (the "City") has jurisdiction over certain <br /> streets and roads located within the boundaries of the City; and <br /> WHEREAS, the City and Florida Department of Transportation ("FDOT") have invested <br /> millions of dollars in the re-pavement of roads in the City; and <br /> WHEREAS, the City wishes to establish minimum standards and specifications to <br /> govern street repair work on streets within the City's jurisdiction; and <br /> WHEREAS, the City wishes to confirm that these minimum standards and specifications <br /> apply to the construction, improvement; maintenance, restoration or repair on City's rights-of- <br /> way and streets within the City's jurisdiction. <br /> NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISISON OF THE <br /> CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> Section 1. Amendment. Section 238 of the City Code is amended to read as follows: <br /> § 238-16. —Maintenance and Repair Standards of Streets and Sidewalks. <br /> A. Minimum Standards for Construction and Repairs. <br /> (1) General Requirements. <br /> When a street or sidewalk is cut or excavated, it shall be done to City standard, which <br /> shall include appropriate traffic control. pavement cutting, backfill. and repair. Any repair <br /> of a street, sidewalk. or road shall be performed to restore the entire work area to the <br /> minimum standards and specifications as set forth in Attachment "A". as amended from <br /> time to time by the City Commission.
