(2) Construction Activities on Newly Paved Roadways. <br /> Pavement surfaces which have been constructed, reconstructed or resurfaced may not be <br /> cut or open for a period of five (5) years after the installation of a new pavement surface <br /> except if the following occurs: <br /> (a) Emergencies that endanger life or property. <br /> (b) Situations in which no alternative course of action exists. as determined by the. <br /> City Manager or designee based on written explanation submitted by the <br /> Permittee setting forth the facts giving rise to the conclusion that no alternatives <br /> exist. <br /> (3) Restoration of Newly Paved Roadways. <br /> Where street cuts are permitted on a newly paved roadway, pavement restoration <br /> shall include a minimum 1 milling and resurfacing of the full width. edge of <br /> pavement to edge of pavement of the roadway for a distance of a full block or the full <br /> length of the excavation to the nearest intersection whichever is greater. unless <br /> otherwise specified by the City Manager or designee. For concrete surfaces, the <br /> restoration limits shall be to the nearest expansion joint. Any street cut of a newly <br /> paved roadway is subject to review and approval by the City Manager or designee <br /> based on the guidelines established in this section. <br /> B. Warranty. <br /> For a period of two years following any work under this Section including repair work. <br /> cuts and borings. Permitttee shall be responsible for the condition of said pavement <br /> patches. cuts, and borings, and during that time shall, upon request from the City <br /> Manager or designee. repair to the City's satisfaction any of the street or sidewalk <br /> surfaces which become settled, cracked, broken or otherwise faulty. <br /> C. State Roads within City Limits. <br /> Where excavation or construction within the limits of the rights-of-way of a state road is <br /> anticipated or performed within the city limits, all provisions of this section shall apply <br /> and have precedence over county regulations or state regulations except where the state <br /> has preempted the authority of the City. <br /> D. Suspension of Permit. <br /> If the Permittee fails to comply with the requirements to repair the street or sidewalks in <br /> accordance with the minimum standards and this Section, the permit may be suspended <br /> and work stopped until such time as the entity preforming the work gives assurance to the <br /> City of compliance with the standards and this section. <br /> Amending.Section 238 <br /> Page 2 of 4 <br /> Words added underlined,words stricken deleted <br />
