<br />ORDINANCE NO. 2006- :>1 ~ <br /> <br />AN ORDINANCE OF THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, AMENDING <br />SECTION 265-37 OF THE LAND DEVELOPMENT <br />REGULATIONS RELATING TO "TOWN CENTER ZONING <br />DISTRICT"; ESTABLISHING BUILDING SEPARATION <br />REQUIREMENTS FOR PROPERTY ABUTTING COLLINS <br />AVENUE; PROVIDING FOR PURPOSE AND INTENT; <br />PROVIDING FOR LANDSCAPE AND UTILITY EASEMENT; <br />PROVIDING FOR SEVERABILITY; PROVIDING FOR <br />REPEALER; PROVIDING FOR INCLUSION IN THE CODE; <br />PROVIDING FOR AN EFFECTIVE DATE. <br /> <br />WHEREAS, the City Commission wishes to promote continuous pedestrian path <br />and pedestrian mobility in order to reduce vehicular traffic along Collins A venue; <br /> <br />WHEREAS, building separation along Collins avenue will encourage the <br />development of pedestrian friendly environments; and <br /> <br />WHEREAS, the adoption of this Ordinance supports a form of development that <br />will encourage safe and active pedestrian environments. <br /> <br />NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION <br />OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> <br />Section 1. Incorporation of Recitals. The foregoing "WHEREAS" clauses are <br />hereby ratified and confirmed as being true and correct and are hereby made a specific <br />part by this ordinance upon adoption hereof. <br /> <br />Section 2. Purpose and Intent. The purpose of this Ordinance is to encourage <br />continuous pedestrian paths and pedestrian mobility along Collins Avenue. The intent of <br />this Ordinance is to encourage greater setbacks and building separation along Collins <br />A venue. <br /> <br />Section 3. Amending Section 265-37. Section 265-37 (F) of the Sunny Isles Beach <br />Code is amended to read as follows: <br /> <br />F. Site Development Standards, <br /> <br />(10) Landscaped open space. A minimum of 10% of the lot area shall be landscaped and <br />improved with ground level pedestrian walkways, courtyards, street furniture, lighting <br />and landscape planting in the case of 90% lot coverage and a minimum of 20% of the lot <br />area shall be landscaped and improved with ground level pedestrian walkways, <br />courtyards, street furniture, lighting and landscape planting in the case of 80% lot <br />coverage. <br /> <br />Amending Section 265-37 LDR Relating to Building Separation <br />Page 10f3 <br />
