<br />(a) All properties abutting Collins Avenue shall provide a lO-foot easement within the <br />required front setback. The easement shall be dedicated to the Citv for the <br />implementation of the Collins Avenue Streetscape Plan. The Citv shall use the <br />easement to increase the pedestrian walk paths, landscaping purposes, placement <br />of utilitv wires and anv other municipal purposes. <br /> <br />(11) Tower separation and tower width. In order to preserve view corridors the <br />following standards shall apply: <br /> <br />(a) Building separation on separate parcels abutting Collins A venue. When there are <br />two towers located on different propertv, a minimum separation of 50 feet shall be <br />maintained between pedestals (50 feet or less in height) and a minimum <br />separation of 100 feet shall be maintained between towers (above 50 feet in <br />height). <br /> <br />(aj-(b) When there are two or more towers on the same property, the building <br />separation shall be a minimum of 50 feet between towers. <br /> <br />(131- (c) The maximum tower width shall be 200 feet. <br /> <br />Section 4. Zoninl! in Prol!ress The provisions of this Ordinance shall not effect or <br />be enforceable against, any zoning applications that have been received by the City prior <br />to the effective date of this Ordinance. The zoning application shall be in compliance <br />with the provisions of Section 265-11 of the City Code. <br /> <br />Section 5. Severability, The provisions of this Ordinance are declared to be <br />severable and if any section, sentence, clause or phrase of this Ordinance shall, for any <br />reason, be held to be invalid or unconstitutional, such decision shall not affect the validity <br />of the remaining sections, sentences, clauses, and phrases of this Ordinance but shall <br />remain in effect, it being the legislative intent that this Ordinance shall stand <br />notwithstanding the invalidity of any part. <br /> <br />Section 6. Repealer. All ordinances or part of ordinances in conflict herewith be <br />and the same are hereby repealed. <br /> <br />Section 7. Inclusion in the Code. It is the intention of the City Commission, and it <br />is hereby ordained that the provisions of this Ordinance shall become and made a part of <br />the City of Sunny Isles Beach Code; that the sections of this Ordinance may be <br />renumbered or re-Iettered to accomplish such intentions; and that the word "Ordinance" <br />shall be changed to "Section" or to other appropriate word. <br /> <br />Section 8. Effective Date.
