Most patrons of adults do not live within one-mile of site. <br /> <br />SURVEY OF EXISTING REGULATIONS AND CONDITIONS IN THE CITY OF <br />SARATOGA SPRINGS <br /> <br />Identification and analvsis of existina reaulations and existina zonina. <br /> <br />Section 240~12.14 of the Zoning Ordinance of the City of Saratoga Springs sets forth the <br />current regulations for locating "adult bookstores" and "adult entertainment <br />establishments" within the City. <br /> <br />These establishments are defined in Section 240-1.5. The Planning Board concluded <br />that these current definitions are narrow and limited. They do not include the full range <br />and variety of adult-oriented uses that have developed in other communities. <br /> <br />Under the existing regulations these "adult bookstores" and "adult entertainment <br />establishments" generally fall within the following uses identified in our ordinance "retail", <br />"eating and drinking establishments", "service establishments", "Group entertainment" <br /> <br />"Retail" use is permitted in the following zoning districts: <br />· As "principal permitted use": HGBD, T-6 <br />· As by "special use permit": T-4, T-5. <br /> <br />"Eating and drinking establishments" are permitted in the following zoning districts: <br />· As "principal permitted use": INST-HTR, HGBD, TRBD, WRBD, T-6 <br />· As by "special use permit": INST-HTR, NCUD-1, T-4, T-5 <br /> <br />"Service establishments" are permitted in the following zoning districts: <br />· As "principal permitted use": HGBD, T-6 <br />· As by "special use permit": UR-4A, T-4, T-5 <br /> <br />"Group entertainment" use is permitted in the following zoning districts: <br />· As "principal permitted use": HGBD, TRBD, T-6 <br />. As by "special use permit": T-4, T-5 <br /> <br />These establishments are not permitted to locate with 2,500 of the property line of any of <br />the following "sensitive site": <br />· School (public, private or parochial) <br />. Library <br />. Park or playground <br />· Place of worship (church, convent, monastery, synagogue) <br /> <br />The existing commercially owned lands where the adult uses might be permitted under <br />the current zoning regulations are as follows: <br /> <br />· The Transect -4 area zoning district off of Gick Road near Exit 15 = 5 acres <br />· The Transect -4 and Transect -5 area off of Church Street between West Avenue <br />and Kirby Road = 63 acres. <br /> <br />7 <br />
