An Ordinance of the City Commission ofthe City of Sunny Isles Beach, Florida, Amending <br />Chapter 253 of the Code of Ordinances to Include Registration of ForecIosed Properties; <br />Providing for Severability; Providing for Inclusion in the Code; Providing for Repealer; <br />Providing for an Effective Date. <br />(Continued from 09/16/1 0) <br /> <br />Action: City Clerk Hines read the title, and Assistant City Manager/Services Vera reported <br />noting that this item was deferred at the last Commission meeting to take a look further into <br />how we were going to implement it. This Ordinance will provide data to the City on <br />foreclosed properties within the City and collect a fee from the lien holders so that we may <br />have the properties maintained to our standards. We looked further into getting information <br />from the Condominium Associations as they have a lot of the foreclosed properties, and we <br />are looking into the Real Estate Tracking System that deals with foreclosed properties and <br />that is the way we will be monitoring. Right now they have submitted over $13,000.00 to the <br />City for foreclosed properties. <br /> <br />Commissioner Scholl said he met with staff and they indicated that they have the tools now <br />to make sure the Ordinance gets applied equally across the board. Commissioner Goodman <br />asked how we handle condos, and Commissioner Scholl explained when a foreclosure gets <br />filed they have to file a document with the Clerk ofthe Court. Staff has a couple of different <br />mechanisms for knowing when that document gets filed and when it gets filed within a <br />property in our City. If a bank doesn't voluntarily come forward to comply with the <br />Ordinance, they can put the bank on notice and send them the proper documentation to <br />register the foreclosure. <br /> <br />Commissioner Brezin clarified that for right now what we are advocating in this Ordinance is <br />just a question of recording, and Commissioner Scholl said that is correct, if a property gets <br />blighted because it is being ignored, we have ordinances in place to take care of that, and <br />what staff got him comfortable with is that we have the ability to track these things now, and <br />there are mechanisms that we can track it with and collect a fee for the registration and make <br />sure that we are aware of them. Mayor Edelcup said it is strictly notification to the City. <br /> <br />Public Speakers: None <br /> <br />Commissioner Scholl moved and Commissioner Brezin seconded a motion to approve the <br />proposed ordinance on first reading. The motion was approved by a roll call vote of5-0 <br />in favor.
