1100111LyML�] <br />ADDITIONAL INSURED: <br />CITY OF SUNNY ISLES BEACH <br />17070 Collins Avenue, Suite 250 <br />Sunny Isles Beach, FL 33160 <br />5.1: Comprehensive automobile liability insurance covering all owned, non - owned, rented, hired or borrowed vehicles <br />used in connection with the award, in an amount not less that $1,000,000.00 combined single limit per occurrence for <br />bodily injury and property damage. The City of Sunny Isles Beach shall be named as additional insured. <br />5.1.2: All insurance shall be issued by companies rated A:7 or better per A.M. Best's Key Rating Guide, latest edition <br />and authorized to issue insurance in the State of Florida. It shall be the responsibility of the vendor and insurer to notify <br />the City Manager of the City of Sunny Isles Beach of cancellation, lapse, or material modification ofany insurance policies <br />insuring the vendor, which relate to the activities of such vendor and the City of Sunny Isles Beach. Such notification <br />shall be in writing, and shall be submitted to the City Insurance Manager within 30 days prior to cancellation of such <br />policies. This requirement shall be reflected on the Certificate of Insurance. <br />5.1.3: Failure to fully and satisfactorily comply with the City's insurance and bonding requirements set forth herein will <br />authorize the City Manager to implement a rescission of the bid award within thirty (30) days of awarding without further <br />City Commission action. The bidder hereby holds the City harmless and agrees to indemnify City and covenants not to <br />sue the City by virtue of such rescission. <br />5.1.4: COPYRIGHTS AND /OR PATENT RIGHTS: Bidder warrants that there has been no violation of copyrights <br />or patent rights in manufacturing, producing or selling of goods shipped or ordered, as a result of this bid. The seller <br />agrees to indemnify City from any and all liability, loss or expense occasioned by any such violation. <br />5.1.5: UNDISCLOSED CONDITIONS: In the event that undisclosed conditions are discovered during the performance <br />of this Agreement, the City shall have the right to cancel this Agreement upon thirty (30) days written notice to <br />contractor. Upon termination, the City may re -bid the project if the contractor fails to perform under this Agreement due <br />to the undisclosed conditions. <br />00210-5 <br />
