The Proposer has correlated the results of all such observations, examinations, Investigations, explorations, <br />tests, reports, and studies with the terms and conditions of the Contract Documents. <br /> <br />7.2.7. The Proposer has given the City written notice of all conflicts, errors, discrepancies that II has discovered in <br />the Contract Documents and the written resolution thereof by City is acceptable to the Proposer. <br /> <br />7.2.8. This proposal is genuine and not made in the interest of or on behalf of any undisclosed person, firm or <br />corporation and Is not submitted in conformity with any agreement or rules of any group, association, <br />organization, or corporation. The Proposer has not directly or indirectly induced or solicited any other <br />Proposer to submit a false or sham proposal; the Proposer has not solicited or induced any person, firm or <br />corporation to refrain from proposing; and Proposer has not sought by collusion to obtain for itself any <br />advantage over any other Proposer or over the City. <br /> <br />7.3. The Proposer understands and agrees that the proposal is for lime and material and unit prices to dear and <br />remove debris generated by a hurricane, tomado, or other natural or man-made debris generating event Estimates <br />are provided for the purposes of Proposal Evaluation and to establish unit prices for individual Work Items to be <br />contracted by the City under individual Task Orders, based on the time and material and/or unit prices established <br />under this proposal. The City and the successful Proposer will establish completion times for each individual Task <br />Order and the successful Proposer agrees that the work will be completed within the time frames agreed upon and <br />stipulated in the Individual Task Orders and/or Notice to Proceed. <br /> <br />o <br /> <br />7.4. The terms used In this proposal which are defined in the General Conditions of the Contract included as part <br />of the Contract documents have the meanings assigned to them in the General Conditions. <br /> <br />7.6. aUAUFICATlON <br /> <br />7.6.1. Contractors will be evaluated for this project based on a twCHrtep process. <br /> <br />Step I. Contractors must demonstrate that they satisfy Mandatory Qualification as outlined in Section 3, Section 4 <br />and Section 9. All proposals Wll be screened for compliance with mandatory qualification elements, such as <br />the required statements of compliance. Those that satisfactorily complete that screening process will proceed <br />to Step II. <br /> <br />Step II. Contractors will be evaluated in accordance with the criteria set forth in Section 62.8 of the City <br />Code. The contract will be awarded by the City to the lowest responsible and responsive proposer who <br />proposal best serves the interests of, and represents the best value to, the City pursuant to the criteria set <br />forth in Section 62-8 of the City Code. Price is only a factor in determining the lowest responsible and <br />responsive proposer. <br /> <br />7.6.2. General <br /> <br />The City of Sunny Isles Beach intends to enter into a pre-positioned contract with at least one prime <br />Contractor who may utiUze both local and non~ocaI resources to provide services in the event of activation by <br />the City following a hurricane, tomado or other natural or man-made disaster.
