<br />RESOLUTION NO. 2007--D3-7 <br /> <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY <br />OF SUNNY ISLES BEACH, FLORIDA, ADOPTING AND <br />EST ABLISHING NON-AD VALOREM SPECIAL <br />ASSESSMENTS ON PROPERTY ON ATLANTIC ISLE <br />BENEFITED BY THE CONSTRUCTION OF SANITARY SEWER <br />IMPROVEMENTS AND ASSOCIATED ROAD RESTORATION; <br />INCORPORATING RECITALS; DESCRIBING THE SANITARY <br />SEWER IMPROVEMENTS AND ROAD RESTORATION; <br />ESTIMATING THE COSTS OF IMPROVEMENTS AND THE <br />PORTION OF SUCH COSTS TO BE INCLUDED IN THE <br />SPECIAL ASSESSMENTS; DESIGNATING THE BENEFITED <br />AREA AND LANDS TO BE ASSESSED; PROVIDING FOR <br />COLLECTION OF THE SPECIAL ASSESSMENTS; PROVIDING <br />THAT, UPON ADOPTION, SUCH SPECIAL ASSESSMENTS <br />SHALL BE A LIEN UPON THE PROPERTY ASSESSED; <br />PROVIDING FOR THE EFFECT OF ADOPTION OF THE <br />FINAL ASSESSMENT ROLL; DIRECTING THE CITY CLERK <br />TO RECORD THE ASSESSMENTS IN THE IMPROVEMENT <br />LIEN BOOK; PROVIDING FOR ADJUSTMENT OF <br />ASSESSSMENTS, IF NEEDED, UPON COMPLETION OF THE <br />IMPROVEMENTS; PROVIDING THE CITY MANAGER WITH <br />THE AUTHORITY TO DO ALL THINGS NECESSARY TO <br />EFFECTUATE THIS RESOLUTION; AND PROVIDING FOR AN <br />EFFECTIVE DATE. <br /> <br />WHEREAS, the City Commission (the "Commission") of the City of Sunny <br />Isles Beach, Florida (the "City") has considered the advisability of certain improvements to <br />benefit property on Atlantic Isle and the funding of such improvements; and <br /> <br />WHEREAS, on June 21, 2007 at a regularly scheduled meeting, the <br />Commission adopted Resolution No. 2007-1115 containing a declaration of the City's intent to <br />adopt and impose special assessments to fund a portion of the cost of constructing sanitary <br />sewer facilities and associated road restoration on Atlantic Isle, and adopted Resolution No. <br />2007-1116 providing for notice by publication and by mail and setting July 24, 2007 as the date <br />for the equalization hearing on the proposed assessments; and <br /> <br />WHEREAS, pursuant to the provisions of Chapter 170, Florida Statutes, and <br />Resolution Nos. 2007-1115 and 2007-1116, the preliminary assessment roll, assessment plat <br />and plans and specifications for the sanitary sewer improvements and associated road <br />restoration have been available for inspection by the public in the office of the City Clerk; and <br /> <br />Page 1 of 14 <br />
